ILR Application for Partners

In UKBA it mentioned as

you and they have been living together in the UK for at least 2 years in a marriage or civil partnership, or in a relationship similar to marriage or civil partnership, and that relationship is still genuine (not a 'marriage of convenience', for example);

My question is I am due to apply ILR, the UKBA states that 'you and they have been living together in the UK for at least 2 years in a marriage...'

In the last 2 years for certain period we are not together in UK. I am in UK whereas my wife is in home country for around 3 months. Whether this will be a problem?

It shouldn't be no, you can have limited absences for good reason, why did she leave?

We had a baby here in UK and after 10 months she went to India with the baby for aprox, 2 months. could be from 20-Mar-13 to 05-May-13. We have left the baby with our in-laws to have a proper care back home.

Now again she's planning to go India for approx 3 months to get back the baby, could be from 28-Aug-13 to 22-nov-13

Thanks Vinny for the details.

As mentioned earlier, I am on tier1[General] and my dependants [Spouse and Child] are on Tier1[General] dependant visa.

Our Current visa's will expires in FEB 2015.

I am eligible in Nov 2014 to apply for ILR.

As my wife will not complete the requirement of ILR dependant of staying together for the last 2 years when applied, so I am planning to apply myself alone for ILR in Nov 2014 for the same day service.

Once I got the ILR,

For my wife - whether I need to apply as ILR dependant or should continue with Tier1[General] dependant still she qualifies for ILR?

For my Child - As he's UK born, shall I apply directly the citizenship once I have got the ILR under section 1(3).

My child applied for PBS dependant leave for the first time after 09-Jul-12.
For the Q34 in [http://www.immigrationboards.com/viewtopic.php?t=79378] - I hope this is not applicable for me, as I am not planning to apply ILR for my child.

Hello experts,

Pls can you help with my case.

I am on T1 (General) from June 2010. Married. My husband was on T2 ICT and recently got ILR. Curently I am on maternity leave (from Mar 2014) joining back on 1 Apr 2015. I do not have sufficient earnings (£34K+) excluding my maternity leave over a continuous period of 12 months (and even if I add April - June it won't be sufficient). I do not have sufficient points to renew my T1 in June 2015 nor apply ILR on this basis.

Please can you let me know what will be the appropriate route?
