Tier 1 Dependant to ILR

Post by King_tier1 » Sun Aug 04, 2013 9:24 pm

I am on Tier 1 and I could apply for ILR on Feb 2015 on 10 year long residency rule. My fiancé lives in UK since 2006( Tier 2) and we living together since 2010 but we do not have any joint accounts or kept same postal address. In October this year we planning to get married and then get her status changed to Tier 1 Dependant. Please members, advise whether our situation will delay her ILR eligibility ?

It's probably better if she continues on Tier 2, if she is subsequently eligible for ILR in her category.

If she wishes to change to Tier 1 dependant after marriage, then she is expected to apply for entry clearance from her home country. Her qualifying period for ILR under this category will be reset (319E).

If you are granted ILR under Long residence, then she should change to ILR dependant. But her qualifying period for ILR under this category will again be reset.
