Naturalisation clarification

Post by Harryp » Thu Aug 08, 2013 4:14 pm

Hello,

Hope someone can clarify please?

In relation to good character for Naturalisation, I do not have debts, any CCJs, etc however last month I got 2 Fixed Penalty Notices for speeding resulting in £60 fines and 3 points on license each time. My driving license was revoked and I have to apply for a new driving license.

The good character guidance on UKBA website states that FPN relating to speeding is not to be declared however I am unsure if this is the case. I obtained ILR in November 2012 and was due to apply in November this year for Naturalisation however I am not unsure if my application will be successful or rejected based on the 2 FPNs issued to me last month.

Could anyone clarify please?

Many thanks

HarryP,

Check Q5

Unfortunately you have to wait for 3 years. In the present climate they will not exercise discretion in your favor even if you had only 1 FPN in the last 12 months.

Since you say they revoked your licence, it will be viewed seriously. Normally a driving licence is not revoked until you have accumulated 12 points in a 2 year period.

Unless you already had 6 points already built up, the only possibilities for the revocation is based on a court direction following their request , when you failed to submit your licence counterpart to record the points for whatever reason or them deeming your actions as dangerous to the public. Kindly update all facts so that we can accurately advise.
