Need some Advise

Post by trustiq » Thu Aug 08, 2013 1:34 pm

Hello! Dear Members,

I have few concerns related to my situation in the UK:

1. I got a permanent job opportunity with an employer here in the UK who sponsored me from India and i came to the UK on PBS Tier 2 General Visa in January 2013.

2. Now, the situation is that i have got another better job opportunity here in the UK & i want to change my Employer resulting to change in my COS(which shall be issued by the new employer).

Question 1: When should i resign from my current organisation?
Question 2: If the time in b/w applying for new visa with new cos is greater then my notice period?
Question 3: When should i resign from my current employer as my new employer wants me to start in 4 weeks from the day of they issue me a new COS?

Thanks!
Shonak

this is a tricky situtation and basically is a grey area as well.

basically, its a risk to resign, even after u have got the COS since there can be a prob in visa issuance coz of several reasons, incl salary, SOC code and job responsibilities.
once u get the visa, u cant work for ur old company as ur sponsor is diff now.
if i were u, i will not give notice, and as soon as u get visa, resign and say i have notified by ukba that i cant work for u anymore and not even serve my notice as it is illegal for me to work for u
i think they wont insist but to comply with regulations.
but this is my opinion, better ask others as well.. but honestly, u wont get a set answer for this.
