It's a pity that due to work secondments abroad, it has become a special case for ILR. I have done the following breakdown to understand better, overall as a professional there is nothing that stops me to be eligible for ILR. However my future travel will further affect my number of days in the country.

I really strongly advise you not to apply. It doesn't matter if you are abroad on business or for personal reasons. Once you are abroad, you are abroad. I really think you are throwing your money away.

I think you can calculate as

02/07/2005 to 02/07/2015 = 10 year (max 540 days out of UK)

do not go abroad anymore untill 02/07/2015

means wait another two year with visa.

Wifes visa expiring tomorrow

HI,
I am little late preparing FLR M. as my ilr is still pending. wifes dependent visa expiring tomorrow 10th aug. is it possible to send by post tomorrow. as they count the date of posting. would it be in time application?

Hi Everyone,

Just quick BIG thanks before my post, this forum has been tremendous help over long period.

Any help would be greatly appreciated.

Sorry if I'm posting in wrong place but I couldn't find answer anywhere else.

I'm due ILR on Sep2013 based on 10 years rule. : 5 Years-Student; 2 Years-PSW; 3 Years Teir 1 General.

My wife in UK Since 2008, currently Tier 1 Dependant until 2015 Nov. (She qualifies old rule before July 2012) 2 kids born in UK.

1- I understand my dependants CANNOT apply same time as me. Do they have to wait until I get ILR then apply? or can they make separate form (After I receive ackn. letter from HO for my ILR) and apply for FLR then SET(O) in order to reduce waiting time for them as well.

2- I haven't got my previous old passport, is SAR ( Subject Access Request) document provided from HO and Police registration showing last 10 Years enough? or Do i need to show doctor letter which I doubt I can get. However I do have copies of old passport every page but there are copies not Original.

Again any help much appreciated.

Hi Guys:

Any news about FLR M processing time, I applied my wife visa on 25 Feb, Bio metric on 5 march.

I got ILR 02 July, I send my visa copy and expedite on ground of her mother health condition and even Involve MP one week before but no response. Long waited.

Could u please give me advise now what do to tnx

you can apply same time the only thing is you have to use FLR M application form for your wife and kids will go on that form as dependent you can send a covering letter with the application that home office should hold their application until decision on your ILR application is reveled once your wife get her flr m she will be eligible for ILR as she has been your dependent on tier 1 more the two years and your kids will be eligible for nationality as they were born in uk (as for i know)
If you don't have your old passport with your try to get those photo copies attested from a lawyer that they are true copies and try to get as many proofs you can get i asked my doctor and they gave a letter from date i was registered with surgery any way not having old passport should not be a problem home office have got your record

My dear members of this forum, I am going to submit my application next Tuesday, the 13th. These are the docs I have arranged to submit:

A: Docs:

1. Form SET(LR) 2. Two pics 3. Passports 4. BRP 5. Life in UK result 6. couple of copies of old acknowledgement letters. Do I need to include anything else? pls advise?

B: few points from the SET(LR) form:

1. page 12, D8: have you ever stayed in the UK beyond the end of your period of leave? does it include the gap between visa extension?

Wife's ILR approved

Hi and Eid Mubarak to the forum.

I just wanted to share good news regarding my wife’s ILR that was approved yesterday at Croydon PEO. She spent 3 years as Tier -1 General dependant and 2.5 months on FLR (M). It was very smooth and efficient process at Croydon. £100 booking fee was deducted from the full fee. Wife's passport validity was less than six months and they didn't object on it.


Thanks to almighty Allah things have gone very smooth for me since my ILR approved. No issues, no objections.

Here is the timeline:
My ILR (10 years) applied: 12th August 2012.
My ILR approved: 01st May 2013.

Wife's FLR (M) applied on: 09th February 2013.
Wife’s FLR (M) approved on: 30th May 2013.

I let daughter's visa expired in Feb 2013 and didn't apply for FLR(M).
Daughter’s MN1 applied: 24th May 2013.
Daughter’s MN1 approved: 16th June 2013.

Wife’s ILR applied at PEO: 09th August 2013 approved same day.

My personal suggestion would be not to make any application for your dependents until you get your ILR. I also understand that your dependents have got enough visa until 2015 and that your kids were born in the UK.

Once you get your ILR approved you can register them as BC using MN1 Form. With regards to your partner, I've experienced mixed reactions, the rule book says to switch them to FLR (M) but then lately one of my friend managed to book a PEO appointment and got SET(M) processed without having to switch to FLR(M).

First of all accept my appology if I am posting in the wrong section.

I need advice regarding me and my wife and my newborn.

I know its too early but i want to prepare what I need to do.

My situation is as follows

Currently Tier 2 and my salary is £20,000 and visa until June 2015 and 10 year completes on Sep 2014.

Wife came as post study dependent on Feb 2012 and switch to tier 2 dependent before 9 July 2012 and visa until June 2015.

Son born in the Uk on July 2013 and not applied for any visa yet.

My Question is what is the best and quickest way we all can get settlement here in the UK?

Also Whether I need to apply for my son as PBS dependent or Not?

I will be very thankful to you.

Assuming that you'd not travel until the above process is completed, I'd suggest not to apply for you child's passport(Home Country) so if you're not aiming to travel then no need to apply for a PBS dependent for your son. Hello,I'm new to this forum . It would be sincerely appreciated if any one you guys can help me answer the questions I have.
My question is about 10 year long residency and 'gap in lawful residency'.
In 2012 , 31th may my visa was finished and I applied for extension same day (by royal mail next day service) .11th June 2012 my application was returned as invalid . I failed to fill up a mandatory section. By 28th June I applied again for extension .28th August 2012 I got extension ( issue date was 28th August)
My question is how it will effect if I apply for ILR?
How long is my gap? Will it be count from 1st June to 28th August (3 month gap) Or 1st June to 28th June (28 days gap)
Can I apply for ILR?

Hi Daminoshallo which PEO did he use for getting Set(M) direct and what did he quote that he comes under rules before 12th of July 2012. It would be appreciated if you can ask him and reply. Thank you

He attended Croydon PEO. I need to mention this, he hired a solicitor to accompany him. Somehow his solicitor was pretty much confident abt going for SET(M) rather than switching to FLR(M) prior to SET(M).

Please note his wife was PBS Dependant (Tier 1 G) and has been more than 2 yrs in this country.

If your case is straight forward, then these docs are fine. don't need the old acknowledgement letters either.

B: few points from the SET(LR) form:

D8 means : if you have over stayed you in UK after your visa expired without making an application for the next visa or extension. If you have made an application (postal) then thats fine.

I am little late preparing FLR M. as my ilr is still pending. wifes dependent visa expiring tomorrow 10th aug. is it possible to send by post tomorrow. as they count the date of posting. would it be in time application?
Yes.
Keep the recorded delivery receipt (in a good state) until she gets her ILR cause if anything goes wrong you will have an evidence that you have submitted your application in time

Hi ya,,, now UKBA are slowing down applications ..what happened ..Now, they need to be investigated again so that they can process fast.

Application Type ILR: SET (o) 10 years (used a lawyer)
Date application posted: 19-12-2012
Date application received at UKBA: 21-12-2012
Biometric letter received: 17-01-2013
Date of biometrics enrollment: 18-01-2013
Refusal letter date: 02-Aug-2013
Date of return of passport and other docs: 12-Aug-2013

Reasons for refusal:
1. Broken leave because spent in total more than 18 months (540 days) absent from the UK.
2. Left UK at one point after my leave was expired and came back after more than 28 days. Therefore the continuous residence was broken at that point and any residence prior to that point cannot count towards continuous residence.
