When can I apply based on British spouse?

Post by db_23 » Sun Aug 11, 2013 9:45 am

Hi,
I will be soon applying for my ILR(WP+Tier1) in person at the PEO.
My wife is a British citizen(by birth) and hence I intend to apply for BC asap.
I am going to apply through NCS

My question is do I need to wait till my new BRP arrives? which could be few days after I am granted the ILR. As I believe I will need the BRP during my application.
I had used my current BRP for the Life in UK test, as the identity document.
Please advice

Thank you

BRP Card is required

Check this

Evidence of your identity

You should provide:

your passport; or
your nationality identity card; or
your Home Office travel document; or
your Home Office entitlement card; or
your Home Office application registration card; or
your immigration status document; or
your residence permit.
If you used one of these documents to prove your identity when you took the 'knowledge of life in the UK' test, you should supply the same document to support your naturalisation application.

I am sorry to say but I dont think you have correctly understood my question.
My question is not regarding what document to supply while applying for BC.

Let me try to explain my real question.
I assume it will take a few days for me to receive the BRP(post ILR), even though I am applying in person at PEO. Does it then make sense to wait for few days till the receipt of new BRP before I apply for BC with NCS?

Hope this helps

It is better to wait until you receive the BRP before applying as I provided both BRP and the letters of approval of my ILR note I apply through postal

Your curent BRP you used in the life in the UK may be retained by home office the day you wil go for ILR

I was having the same issue and I never includ it during my naturalisation application but I do wrote on the additional information that my BRP I used to took the life in UK was retained by name the PEO office u are going to use .

My advice is out of my experince I hope other members of the bord wil able to guide and advice you . I wish u the best.

You can apply and need not wait

Dear db_23,

Since your BRP is already with the Homeoffice, mention that in the additional info section and apply straight away, as gudgud1 has kindly suggested.

Good Luck!

db_23, do ensure that you were physically in the UK exactly three years before UKBA will receive your Naturalisation application.

Hi,
Thank you very much for this update.
I will apply the very next day and mention that the BRP is with Home Office.

I was in UK the whole month of Aug 3 years ago, Thanks for the reminder though.
