FLR M form questions and documents to be sent

I have applied for 10 years ILR and still waiting for result, as my wife visa runs out this month end, I am sending her application with a cover letter. I have the following questions, where I am finding it bit tricky to answer. Can anyone, share your experience? Thank you.

In sec 3.15 – I have mentioned as decision awaiting, applied for ILR under long residency category, enclosed HO acknowledge letter and reference number, hope this is correct?

Under section 4, we have a UK born child who is 4 months old, as I understand that we do not need to apply visa for him, do I need to include his details in sec 4.6?

Also, please advise me if I am missing any documents, thanks again.

I am sending fully filled FLR M form with
• Marriage certificate original and translation
• English language test result original trinity college
• 3 months bank statements of mine and pay slips of mine
• Water bill which has both names
• council tax bill reminder (with both names) as I have sent council tax bill with my ILR 10 years application, I don’t have another copy, hence I am sending payment reminder letter
• Tenancy agreements which has both names
• Landlord letter which has both names
• Doctors & NHS letter wife name and address
• 2 x photographs of my wife and name written on the back, 1 x photograph of myself
• Cover letter - explaining that I have applied for 10 yrs ILR and awaiting for result with Home Office ref
• Photocopies of all documents
• and wife's passport
and payment page signed by myself.

Hi Guys,

Please advise whether I should include my UK born chid in sec 4.6 of FLR M form?

I am confused, please help me!! thanks

No, add their details in 4.9 and write will be registering as British by virtue of section 1(3) BNA upon parent being granted ILR as child was born in the UK.

I assume your spouse was a PBS dep prior to July 2012 see here (click) for documents.

Thanks for your reply, for sec 4.1 - Do you and your sponsor have any children together? should I say Yes or No

My wife is dependent of work permit holder, my work permit was issued in Sep 2008.

Is FLR M is the right form? Thanks in advance... I was confused by a solicitor saying that I should find dependent of WP holder form.

Confirm that you are indeed under a work permit and not T2 PBS?

My HO letter dated 01 Sep 2008 says

Thank you for your client's application to remain in the UK as a work permit holder. I am pleased to tell you that your client's application has been approved and goes on...

My Wife visa also states that Work permit dependent

I believe I was granted leave as work permit holder..

I believe I am workpermit and my wife was granted leave to enter as wp dependent..

Then if she satisfies the requirements of 196D (click) you should be looking towards settlement on set(o) for your spouse.

She does not qualify as she only joined me in Jan 2012 and spend 1 year and 6 months.. Is that means that I should apply with FLR (M) and for sec 4.1 , should say Yes?

I apologise for being a pain, I am stressed and confused.

I will answer yes for 4.1, as we have UK born child and explain in 4.9 that I will be registering British by virtue of section 1(3) BNA upon parent being granted ILR as child was born in the UK.

It expires at the same time as mine 01/09/2013. I have already applied for ILR and waiting for result, I have an acknowledgement letter from HO

What part of rule 196D does your spouse not satisfy? Subject to a decision after you're granted ILR?
