EEA4-When can I apply, or should I apply for naturalisation?

Post by augusto » Sun Aug 11, 2013 2:00 pm

Hi All,

I've been reading posts about when can I apply in the forum but I still cannot fully understand when can I apply for an EEA4 in my situation, or if I should skip the EEA4 and apply for naturalisation

3/2008 - Moved to the UK with my Dutch (at that time) girlfriend. I had a WP at that time.
10/2008 - Got married.
2/2009 - Applied for EEA2 resident card.
10/2009 - Got EEA2 resident card.

So my question is when can I apply for a PR?
- 5 years after we moved in the UK?
- 5 years after we got married?
- 5 years after I got the resident card (EEA2).

Or can/should I apply for naturalisation after 5 years of being married and living in the UK?

Thanks a lot!
Augusto

It is after five years' legal residence, ie residence in accordance with the regulations.

In your case, it would appear to be 10/2013. This assumes that your wife exercised treaty rights all this time.

You need 1 year of an unrestricted stay, so that would be naturalisation at six years. Naturalisation Requirements

as long as your spouse was excersising treat rights then it would be date of marriage.

the EEA2 confirms the right you already have.

Residence documents for non-EEA family members of EEA nationals wrote:When you have lived here for a continuous period of 5 years with the EEA or Swiss national (who must have been in employment, self-employment, studying or self-sufficient in the UK throughout the 5 years), you can apply for confirmation of your right to permanent residence in the UK.
Still confusing?
