Work permit + EEA2

Post by alexgrd » Mon Aug 19, 2013 5:32 pm

I have been in UK for over 6 years.
First as a Work Permit holder, and then I had EU Resident Card (as a spouse of EU citizen).
During that time I was and still is with the same employer.

Could I still apply for ILR as a worker using SET(O) form?

Thank you for your advice.

this is one the common mistake people make.

I know someone in the same boat. Switched to EU route after 4 years in Work permit. If he didn't switched then by now he should been a British Citizen but UNLUCKY HIM must wait and apply for PR under EU roles

There is a difference between residency based on domestic immigration rules and the EU freedom of movement rules

You can only apply under Long residence ( ILR after 10 yrs legal resident in the UK ) or as Family member of EU national ( PR 5 years after marriage )

but in both case you must show that your spouse was exercising treaty right.
