I would like to ask one question regarding future matters with my wifes PR, maybe someone here would be able to help me. My wife has been issued RC few days ago. When shall we apply for her PR ?

1. 5 years from the date her RC was issued (08.2013)

2. 5 years from the date her Biometric Residence Permit was issued (issued on 12.2011, valid until 02.2013)

3. 5 years from when we got married (11.2012)

EEA4 application

Post by victoria2 » Sat Aug 24, 2013 12:06 pm

Hi guys,
If anyone can advise me in the following, I have received my 5 years resident visa twice, 1st time when I join my husband in 2007 so my visa was issued in 2007 to 2012, and second time when I brought my son to the UK in 2010 , we both received 5 year residency from 2010 to 2015. The question is can I choose period from 2007 to 2012 to get my permanent residency or I have to be up to date and cover period from 2008 to 2013?
Many thanks.

Assuming you were living in the UK when you got married, then 5 years after marriage.
Not sure what you mean by biometric Residence Permit. Was she under the UK immigration rules?

She was issued Biometric Residence Permit , because she entered to UK on student visa. So technically she was resident since that time otherwise she wouldnt of got this permit, thats why im confused when to apply for her PR.

After many months of frustrations and endless phone calls I have picked up my Residence Document from the Post Office this morning!

Here is my timeline:

Submitted EEA4 (Retention of Rights)- 5 October 2012
Received COA - 10 October 2012
Issued Residence Document - 21 August 2013
Received Residence Document - 5 September 2013

Funny enough, I received a letter in the post after 4x complaints from my local MP to advise me the UKBA will make a decision within 6 weeks, LOL - the letter arrived the same day the Residence Document did.

I've been calling the UKBA for the last few months to get a status on my application. I've always been told that it had not been looked at yet and that I needed to be patient. When I called today, the man said it had not been decided yet but that it was being considered. Does this mean that it might actually be with a caseworker now, finally, after roughly ten months?! This wait is driving me bonkers.

EEA3 and EEA4 time line

Post by luizalotos2000 » Thu Sep 12, 2013 12:25 am

Hi All,

I can see that everybody has different experience from very good to really bad ones....

I'm sure that all PR which they been received in short time was consequence of good preparation.

Agreements attached with payslips and P60 periodically , each year separately plus all additional documents are presented as well with periodic order, separately.

Covering letter which is mirroring all presented documents plus explain additional circumstances : change names etc.

All above will make much easier for HO case worker to analyze and make quick decision.

Even I know very well my self how to fill in applications, organize documents etc I decided with my husband to apply by solicitors in hope that applications will be processed in sensible time.

I did prepare all properly but solicitor massed up with some information ( i received copies of our applications plus covering letter ).
I was immediately unhappy because for EEA3 and EEA4 is absolute key that all information in application is clear and straightforward if no, I'm almost sure that this main cause of all delays.

I'm writing all this to make you aware that you can't trust even your solicitor ! and before sending applications is better to ask your solicitor to see not only how application is fill in ( I found some mistakes and not periodical time line with my work , hope Ho will don,t see that but if they will, they can easy ask to clarify or send additional documents ) but as well how documents will be presented along with covering letter - if no - you can regret that.

Our applications as well was sended 2 weeks later that they was suppose.

I just hope everything will be ok without any unnecessary delays and problems because when I seen all copies I wasn't happy how information was presented and delivered in our applications and covering letter.

I'm Polish and my husband is Iraqi Kurdish

29 / 07 / 2013 - all documents for EEA3 and EEA4 passed to solicitor

09 / 08 / 2013 - solicitor fill applications

12 / 08 / 2013 - we received an apology with information that applications will be send on that day.

15 / 08 / 2013 - HO send letters to our solicitor about receiving our EEA's and passing them to caseworker unit to await consideration.

10 / 09 / 2013 - HO send COA to my husband EEA4

Until today we did not received back any documents and I did not received any letters about my EEA3

After 11 months of waiting, I'm ALMOST to the finish line. UKBA told me that the decision was sent to my solicitor earlier in the week. I called the solicitor and they haven't received anything yet. So, fingers crossed, by this time next week, I will finally have my PR.

Hi, as I read in previous posts the best and effective way to get PR after 6 months of waiting is TO GO AND SEE YOUR LOCAL MP.. You can easy find your local MP by this address : http://www.parliament.uk/about/contacting/mp - in " find " window fill your post code and then will show you names of local MP with addresses and all information you need.

I'm happy to help you and please don't worry. I know that is easy to say but I can be the one on the same boat as you are now.

My point is that whatever problems you passing now, happen to many others too and all of them ( excluding some complicated cases but still not always ) at the end received Permanent Residency.

In fact is just a few, compare to all rest of the group, whom HO gives PR in short time.

Most was waiting couple of months and the same time quite big group passed lots problems

I become angry many times how Ho is makes them decisions, almost constantly ignore even solicitors and Law ! Is absolutely unprofessional and unacceptable.

After our hope and solution is rest with MP only !

As normal people we do not have tools and powers to get any sensible respond from them as we been over and over, constantly ignored.

Remember never give up even you are facing lots of problems now ! After passing your case to MP you will get your PR. :D

7 Months 20 days to get EEA4 PR

Post by EEA4ever » Wed Sep 18, 2013 9:49 pm

Dear everyone,

I received my passport back with PR stamp finally

timeline:

Submitted EEA4 and EEA3 – 28 Jan 2013
Received COA – 4 March 2013
EEA3 PR received 28 April 2013 ( 3 months )
Permanent Residence Card issue date on Passport sticker EEA4- 15 September 2013
Passport and Document received - 18 September 2013 ( 7 Months 20 Days )

Documents submitted for EEA4 and EEA3:

- 5 years Employment P60's/Salary slips (EEA National)
- 3 years joint council Tax yearly summary ( total 3 pages for 3 years) +1 year joint Tenancy agreement + 1 year separate bank statements of EEA and Non EEA national
- Marriage certificate
-Workers Registration Scheme document of EEA national

NOTE: I did not put EEA4 applicant’s work history at all. Even though we had all the papers but it is not required so did not add more cluster.

You can put four years P60 + fifth year's pay slips of EEA national + 5 years residence proof for EEA3 and EEA4

I tried to minimise the papers as it would make things easy for case worker.

I never called HO as I know it is useless. I only wrote one email to remind UKBA that 7 months 15 days gone so please process my application ASAP. Within 5 days, I got my PR and docs !!!

Thank you for sharing your experience and expertise.
I wish all the best to all.

EEA4ever
