urgent Help .......... 5 years cap ..........

I came in uk in September 2004 and I did
1. BBA from a private college ( September 2004-August 2007) It is not a recognized qualification

2. Diploma in IT from a private college ( December 2007- August 2008). It is not a recognized qualification

3. Cert. in Business Management from a private college ( December 2008- December 2009). It is not a recognized qualification

4. Level 4 Diploma in Information System from IMIS ( Jan 2010-Feb 2011)….Tier 4 visa


5. Level 5/6 Higher Diploma in Information Systems from ABE ( Mar 2011- July 2013) ….Tier 4 visa

Now my visa is going to expire in December 2013, some one told me that 5 years cap will applicable to me. so what should I do now...........

Forget 5 years cap, the maximum period you can spend on student visa (either old or new) is 8 years and you already spend 9 years. So actually you cannot apply any UK visa in this student category anymore. Try to switch to some different category like Tier-1 or Tier-2.

Does Home Office consider time spent in UK as student before March 2009 towards the cap? I thought the rule dose not backdate and applies only for time in Tier 4 category.
