WP+TIER1 eligibility for ILR, few days short-Success

PEO Sheffield, Success on the day! The whole process took about 2 hours 15 mins. Sheffield PEO is quick.

This post has quite a few elements that might help for those who are preparing for the BIG DAY.


WP+TIER 1 (general)

WP entry clearance on 7/10/2008
Entered UK on 27/10/2008
WP visa valid till 7/10/2010

Tier 1 Extension approved and stamped on 16/9/2010
which was submitted before 6/4/2010 though, rejected in the first place due to the maintenance problem and then approved after an review.

Tier 1 valid till 16/9/2013

element 1: visa not totalling 5 years.
element 2: not even completing 4 years 11 months physically
element 3: out of job for 11 months
element 4: tier 1 visa approved in September 2010 yet still following the rules set before 6/4/2010.
element 5: I had a child dependent with me approved even mother was not applying at the same time.

Documents provided: (suggestion: provide documents only related to the points, not more, not less)

1) Bank statements 12 months
2) Payslips 12 months
3) employment letter (employment and absence)
4) passport (current and previous) + 2 fotos
5) birth certificate (translated myself)
6) son and wife's passports
7) police registration certificates

Documents with myself:
1) P60s
2) Utility bills

I am 21 days short for the 5 year anniversary, am I eligible for ILR? And when could be the earliest date that I can apply in person or by post.

How many points at least do I need to score? 75 or 80?

Your advice is greatly appreciated!
Anyone on the same boat?

For WP migrants and Tier 2 migrants, salary should be at least equal to the relevant SOC code as mentioned in the Codes of Practice (COP).
For Tier 1 (General) migrants, points are awarded according to their previous earnings in a consecutive 12 month period (within 15 month window) preceding the application.
Note for Tier 1 (General) migrants - The points one must score depends on the date of initial application and the rules in place on the date of such application (245CD(d) and 245CD(g)). The date on which the leave was granted is irrelevant. Likewise, whether you earn more or less or same as at the time of initial / extension application is irrelevant as long as you score the min. required points at the time of settlement application.

I can see how you could have applied on 16-09 and be withing 28 days of the 7-10.
You applied on 28th August, right? That's way before 28 days until 7th of October!
