Wifes Eligibility for ILR

Post by japs411 » Mon Sep 02, 2013 9:30 pm

hi
have some confusion around my wife's eligibility on ILR

my wife was in UK on student visa and then PSW ( two years visa )

I was in Tier 2
we got married in April 2011 in UK and she obtained dependent visa(Tier 2 Dependent )

I received the ILR in Jan 2012 we applied again using SET M since my status was changed her new visa is valid till july 2014

Question
1. is she eligible to apply for ILR in her own right ? (two year dependent rule )
2. if no then when she is eligible ? July 2014 ?
3. if no to point 1 then do we need to do anything after my citizenship status change ? i.e. send another FLR (M) ?
4. if none of the above then when will she be eligible

the reason for my confusion
she has completed more then 2 years as my dependent
out of which
1 year as Tier 2 dependent
1 year as ILR dependent
and 4 months as British citizen dependent

so not sure how the two year rule works

your help is much appreciated

thank you
