Insufficient details.

What's your immigration history?
What's your wife's immigration history?

I have recently got ILR based on Tier 1 General a week ago

My wife is Tier 1 dependent.

She got tier 1 dependent visa on 30 March 2012. (she has not completed her 2 years stay here yet)

Many many thanks for your help

Dependant ILR

Post by ssidd » Mon May 13, 2013 12:57 pm

Hi,

I am on TIER 1 (General) and my ILR is due later this month. My wife joined me in UK IN October 2009 as TIER 1 (Dependant), My question is

Is she eligible to apply ILR with me in couple of weeks?

My understanding is 5 year dependant rule is applicable for those who applied after july 2012. Please correct me if I am not right.

Thanks in advance.

Regards
Sidd

The FLR (M) form states that you need to apply using PBS dependent form.

Could someone please clarify this ?

How may years does she need to wait to get ILR?

I believe 2 years because she got Tier1 dependent before July 2012

Many many thanks for the help

Thanks for the help,

She has recently got extension using PBS Depenedent form and UK Border gave her visa until August 2016.

Does it mean that we need to wait until then to apply for ILR where as her two years will be completed march next year

your help is much appreciated

thanks,

You need to wait until she has complete 2 years then apply on SET(O) the visa expiry date is irrelevant (though obviously needs to be valid at the time of application).
