Tier 2 ILR query - on new rules

Hi guys,

I understand, that under the new rules immigrants can stay up to 6 years on a tier 2 visa. 3 years at first, followed by another 3 years at max.

Hypothetically:

If someone has worked with an employer for over 5 years but their salary is not 35k (or according to SoC code - whichever is higher), can they just switch the employer in the end and apply for ILR, if the new employer is paying them at the appropriate rate required for ILR.

If someone has been in the UK on a Tier 2 visa for more than 5 years, would the new employer need to provide a new CoS or RMLT or can they just say that the employer is working with them and have a 35k above salary?

Also - if the new employer gets the RMLT test done and meets all the other requirements, can the applicant directly apply for ILR after the Tier 2 is issued. Since they have been in the UK for more than 5 years. Or do they have to wait for a certain period?

If someone switches to another Tier 2 employer after working for one for 5 years, do they automatically become eligible for indefinite leave to remain?

I just know that if your visa was issued after April 6 2010 you wont be able to apply for an ILR unless you change sponsor !!!
