WRS question

Hi there. I want ask about WRS. I was working in 2010 for one company and I was registered but then I left for 2-3 months and then started work for them for 1 month again from 01/2011 but I didn't registered again. Was my first registration still valid or I should registered again. Orwas there any period which i didn't need to register for some time?

if the first probationary 12 months under WRS scheme were not completed then each time while changing employer the A8 national worker needed to re-register again under that scheme. If you restarted work again for same employer even not resigned/removed then that registration must have been valid. That scheme existed between 2004-2011.

Yes. My registration was from 07/2010 and I left that company and went out of UK from 10/2010 and then I came back 01.2011 for 1 month and worked for the same company like previous year. So was it still valid?

If on restarting the work with same employer if the employer did not suggest to re-register and you did not get any notification regarding your previous wrs registration then i think you will fine.

No, they didn't care. But I don't know what will say people from border office when I will be asking for PR.

if you are still unsure then for a nominal fee usually £10 can request Sar file from ukba which under freedom of information will disclose all the record they kept for you. This way you can solve this mystery.

normally you need to show 12 month under WRS.

what you can do show payslip not for 12 months but 4/5 months

back in 2009 when i applied for EEA2 Home office require 12 months under WRS my wife exercising treaty right. I did only send couple of them not for every months

home office will not know that you left and started again unless you tell them

yes you are right i don't think any employer knew at that time about WRS. they never bothered to ask.

But when I left UK in10/2010 they sent me p45 and when I came back in 01/2011 and worked for them only 1 month they sent me payslip which started from 0 and p45 again when I finished.

little complicated. if it's for PR application then Home office may scrutinise your application ( check with HMRC )

If it was for EEA1 then it's may be not a problem

Try your luck. send some payslips and old contract letter.

if you started work in january 2009 send payslip for january 2009, april, july, september, january 2010. They may not find out.

Yep. It is for PR.
What if I will use Employment history which I have from HMRC? According this paper I am still working for that company even though I quit in 02/2011.
Now I am waiting for all these Employment history sheets from 2009 - 2013 which I hope I can use as a prove of employment together with WRS from 2009/2010/2011.

What do you think?

How does it work?
You will normally have to register under the Worker Registration Scheme if you wish to work for an employer in the United Kingdom for more than one month

Once you have been working in the United Kingdom legally for 12 months without a break in employment, you will no longer have to register on the Worker Registration Scheme

They will only count your registered work; I asked this question to an European caseworker and he confirmed that even if you have worked 1 year before registering under WRS scheme ( for a8 national ) it will not be count . They will only count work from the certificate issued date

What counts as 12 months ‘uninterrupted work’?


'Uninterrupted work' means you must not be out of work for more than a total of 30 days in a 12 month period. You will need your registration certificates and other evidence of employment to show 12 months' uninterrupted employment.

What it mean is if you didn't register that employer with WRS. If home office don't any any record that you worked for them then it's illegal

any work you did from WRS issued date to next 12 month must be informed. If you changed 4 jobs in 12 months you need 4 WRS
