EU1 - High Court Decision

Hi everybody,

I have just suscribed. I must say I have been reading most of the posts concerning EU1 and they have been of great help (information: at last!!! :lol: ).

My main question is: Does anyone know the date in which a decision will be taken by the court on the matter of the EU spouse residence application (EU1)? And how can we find out what is that final outcome?

Just to introduce myself, a few details:
1) I am from Argentina (visa waiver country).
2) My husband is from Argentina
3) My husband also has a Spanish passport.
4) We have never resided (together or separately) in any EU country.
5) We have been in Ireland for over 2 months, my husband working for over one month.
6) We have sent EU1 and documents 2 weeks ago.
7) Like everybody, we were not warned of any of these problems or additional requirements by any official means (not in the Irish Embassy in Buenos Aires, the immigration officer at Dublin airport or the GNIB :evil: )

Decision expected on the 5th june

According to my latest info through this website.
I know the system is crap its just to discourage people from thinking if this as an easy option

I havent even got my acknowledgement till now

i posted them on 14th of this month
and after 2 weeks my case is not in their system.

Loads and loads and loads of cases there waiting for the decision.

According to the postal service, they received my application on May 11th (Friday). That makes today working day number 11. If I don't receive the acknowledgement and documents back this week, I'll start with the faxes, calls and letters...

What is your situation (nationalities, term of residency, etc.)?

Been living here since 6 years on student visa.

Originally from Pakistan

Lived in london on sereral ocassions for period of up to 4 months

Always had UK multiple visa for up to 2 years

married with an EU national Polish

She is living here sice 2 years and working


P.S yes bombard them with faxes and letters but be nice

you know they are nice people they are just doing the job what they have been told. Its the Mc dowel who introduced this Shite !

The ridiculous thing about the whole issue is that they don't ask for information about prior European residency even in the E.U 1 form...it's stupid to judge your application based on something that they don't even ask in the first place!

Archigabe,

I know!!!! I think that just the fact that they are not being straightforward with this, builds a case against them.

If the High Court's decision doesn't benefit us, we will have to head back home, I don't think we would have the money to start all over in the UK, for example.

You wouldn't believe the money, time and effort we have spent... and just by telling us that they were requiring something like previous residence in a EU country, we would have decided to go elsewhere. It's so unfair!

Do you think, if they reject the application on this basis, there's a way of suing them for the money lost and the trouble that we went through? I mean, because they are the only ones to blame, simply by not letting us know the real requirements and encouraging us to go to Ireland. At the embassy they made it sound so easy and they emphasised that it was our right...

They cannot play with people's lives like this.

Flor use the Solvit complaint. Search for Solvit in this board, and you will find the link and how to submit a complaint. I don't know if anyone has been able to actually get the money out of the DoJ for lost wages, but at least I hope it is possible.
How about Spain then? Would it be possible for you to get a work permit in Spain easily?
If you want to consider UK still, I could find you get a very quick job there, if you are not afraid to do industrial work until finding something more appropriate. At least it would pay the bills for a while. PM if you want more info.
While you have already come all the way to here, I'd still try to give UK or Spain a shot. Take care.

Go for it runie!
I can't get that site (where you are supposed to apply from) to work. I get the same error in all my browsers, and get to the lousy helpdesk page, "empty your cache". Same on all browsers and on 2 other computers we tried.
So even the application page works as great as the whole EU1 process. :lol: does it work for anyone else?

That job ad looks like it is for Deloitte, not the Irish government, unfortunately. Oh, well.

You'd be working on immigration cases and such for their employees, is my guess.

Even if it was for the Irish government, I know a few people who work for it, and they hate it. They say it is totally demoralizing and pointless going in to work. That probably explains a lot about how they run things.

When you make complaints or send in appeals regarding the Residence permits for E.U spouses, do refer to this European Court of Justice Decision in January 2007 which made the Swedish government issue the residence permit to Yunying Jia. The Swedish government had also demanded prior residency in another european country similar to Ireland.
The High Court case is to be heard on the 8th of June.

Operative part of the judgment:

1. Having regard to the judgment in Case C-109/01 Akrich [2003]
ECR I-9607, Community law does not require Member States to make the grant of a residence permit to nationals of a non-Member State, who are members of the family of a Community national who has exercised his or her right of free movement, subject to the condition that those family members have previously been residing lawfully in another Member State;

2. Article 1(1)(d) of Council Directive 73/148/EEC of 21 May
1973 on the abolition of restrictions on movement and residence
within the Community for nationals of Member States with regard
to establishment and the provision of services is to be interpreted to
the effect that ‘dependent on them’ means that members of the
family of a Community national established in another Member
State within the meaning of Article 43 EC need the material
support of that Community national or his or her spouse in order
to meet their essential needs in the State of origin of those family
members or the State from which they have come at the time when
they apply to join that Community national. Article 6(b) of that
directive must be interpreted as meaning that proof of the need for
material support may be adduced by any appropriate means, while
a mere undertaking from the Community national or his or her
spouse to support the family members concerned need not be
regarded as establishing the existence of the family members' situation

Hi Flor_mz,We've already been rejected but we are waiting for the court case to be heard on june8th...IF this gets ruled in the negative, some of us are planning on a joint case similar to a mass tort/class action lawsuit so that we can share money on legal expenses, and we will be presenting a united front.I guess we can even sue for lost livelihood/earnings.

sorry I think Minister for Justice Equality & Law Reform –v-Draisey has something to do with European Arrest Warrants.

It says "hearing" it means you will not have judgement that day anyway if i am thinking right . So means more wait and more dates.

Is this not a mouth piece of the Irish goverment as they are the one who fund this ?

Anyone tried them before ? I have the least faith in state institutions when it comes to the rights of foreign people

im more concern about the communication problem!!! doenst matter what they do but at least answer the bloody phone!!!! im given up ringing the department all the time with no answer......

does somebody know any of immigration people personally or even know where they live. im trying to find out their addresses in dublin.

Good information archigabe

But i would take that with a pich of salt. These people recieve funding from government and give them feedback on what the public wants to do.

Its like a loop hole detecting orginization which on the face of it look like that it favours immigrants.

They report back all data what immigrants are trying to do and what loop holes are available and how to further tighten the law !
