Qualifying date for Naturalisation

Hi guys
sorry if this topic had been discussed before I I tried to search but I couldn't find the answer I was looking for

I entered the Uk on 3rd October 2007 as fiance of an eea national
We got married 30 October 2007

been living together all the time and got a son who is British national
I completed 5 years as non eea family member of an eea national in October 2012 and applied for PR which was sent in October 2007 it took me six months to get my docs back.

Now technically I will have 6 years completed on 3rd October 2013.

Question is do I apply for naturalization after 3rd of October 2013 or should I apply when I got my PR stamped dated march 2013.... (meaning 12 months in march 2014)

I will try to explain it more if I don't make any sense

sent for PR in October 2012. Received docs back in march 2013 (this is the normal processing time of home office any time sent my docs in the past eg eea family permit and then transfer of stamp on my new passport)

please any help will be appreciated as I want to send for naturalization before the law changes on 28th of October to have esol as well as life in the UK test

I am probably not the best person to answer your question, but I think there is important date which was issued your PR which is different then day you had send your paperwork or received it.

Hi spidermann,

I am in a similar situation. My wife and I applied for PR after 5 years (3 years unmarried partner + 2 years married). They took 8 months to grant us the PR (June 2012) so I am not sure whether I should apply for Naturalisation in October 2013. I already took the test and passed it but when I called the NCS they did not want to book a date for me because they reckon it must be 1 year since the date on the PR or I must be married for 6 years. Apparently they checked this with the UKBA and they said that unmarried partners or durable relationship without marriage does not count.

If someone could provide some advise it would be really appreciated. Thanks!

hi all,

bit confused. me n my husband gor ILR 25/10/2012 on basis of my 5 years of workpermit. now according to ukba i think we qualify for naturalization 24/10/2013 so does it mean that my application can reach ukba on 24/10/2013 n after that. so can i go for NCS on 23/10/13 or it has to be 24th.
because new rules apply on 28/10/2013 of english test. 26/27 oct are weekend dates.

it just we dont want to give IELTS (west of money) both of us got degree from india in english. so if we cant apply early we ve to apply for NARIC (again west of money )

please please advise....

I'm in the same position than you. I got my ILR on 26/10/2012 and in theory I could apply on the 25th October (Friday). That will be having NCS appointment on Thursday 24th so my application get delivered at home office on 25th.

I decided is too risky to play with so tight dates and got appointment for the 28th October (Monday). I have done my IELTS and just waiting for the new form to be updated so I can fill it.

I have a friend who was married to an EEA, entered UK on 20/12/2007,obtained his PR in May 2013, got divorced on July 2013 then married again early Sept 2013 to a British national.

Now, can he apply straight for naturalisation by virtue of marriage to a BC or does he need to wait until May 2014 ( 12 months after PR)?
please note he will complete 6 years residence in 20/12/2013!

if the answer is yes, then can any one recall a successful case/s ever mentioned in this forum?

Have you had a RC or EEA Family Permit as unmarried partner? Your time starts when a residence document as unmarried partner was issued. If you didn't have one, consider yourself lucky as your PR Confirmation should have been refused.

If he has a PR card and is now married to a BC, he can apply. No need to wait 1 year.
