Questions regarding absence from UK, PLEASE HELP ME!!

Post by jeremy001181 » Thu Aug 08, 2013 9:56 pm

Hi

I am under Tier 1 general, my absences from UK for each year of 5 I claim, is less than 180 days , however, total absences of 5 years is more than 180 days.

Base on my situation, I have 3 questions:

1. Do I need to provide employer letter to prove my annual leave absence?

2. If yes, my previous employer refuses to provide letter, what alternative evidence can I provide?

3. I was unemployed for 15 days ish due to job change, and I went abroad for 13 days, what evidence can I provide for this period?

Please help me!!

Thank you v much

Ming

If your absences are less than 180 days per 12 month period, you shouldn't need a letter

Thanks for your reply,

This is very confusing, on section 6.2 of set (o) form, it says:

Evidence of all work-related absences (including paid annual leave) is required from those applying
under Tier 1 (General);Tier 2 (Intra-Company Transfer);Tier 2 (General); Tier 2 (Minister of religion);
Tier 2 (Sportsperson); Tier 5 International Agreement, and permitted employment categories - except
Highly Skilled Migrants.

and on right next section, it asks "What evidence has been provided to support the reasons for all absences from the UK?"

Nothing on the guideline or the form mentions "employer letter is not needed if absences are less than 180 days per 12 month" or anything like that,

I might miss out important information when I read through the guideline, can you show me where you found the information please?

Many thanks

Nothing on the guideline or the form mentions "employer letter is not needed if absences are less than 180 days per 12 month" or anything like that,

Nothing can be shown on the UKBA website or guidance policies that 'an employer letter is not needed if ...."
Seniors and gurus in this forum can only advice you based on their expertise and experiences. If you search this forum, there are countless cass where they were not asked for employer letters if the absence is below 180 threshold.

Thanks mate, I feel much confidence now

So I can basically skip section 6.3 without ticking any boxes below then?

6.3 What evidence has been provided to support the reasons for all absences from the UK?

Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK?

Letter from applicant detailing reasons for absence due to compelling or compassionate reasons

Original official documents: (medical/birth/death certificate(s))

Letter from travel companies to evidence disruption to travel

Other

Hi jeremy001181....
I have a case very similar to yours and thinking of applying for ILR soon.
Can you please tell me if you have applied for your ILR and how did it go?
Also, did you attach any letters from employers for the days absent from the UK?
Your response will be helpful.

Many Thanks

I am in similar situation. I was not employed during 42 days outside UK. I booked an appointment with PEO for tomorrow. I got letter from current employer for leaves but no letter for previous absence.

I will update this post with my experience.
