ILR query - independent tier-1 to depndnt ILR applicant

Hi friends,

I had entered UK on 1 Feb 2009 on Work Permit.
Switched to Tier-1 Visa on 07 May 2009.

My wife has her own Tier-1 visa and she came to UK 02 Jul 2009. Since then we have been renewing our own visa's never went the dependent route.

Now I complete five years on 01 Feb 2014. So my question is can my wife apply as my dependent for ILR visa application?

In July 2014 your wife will be eligible for ILR, the other option is to change her to your dependent even then she will have to wait 2 years after you are granted with ILR to get her ILR.
You would probably save some money on a joint-application but if you want ILR for both of you asap, then separate ILRs are the best.

That is incorrect, the dependent would have to wait 5 years as a spouse not 2.

I am also on the same boat-- I am on tier 1 visa and my husband will be eligible for ILR soon. I am trying to become his dependent so that we can apply for ILR together.
Could you please share - what you did with your wife's visa??

Hi Skum,

Nothing yet.. still in dilemma, my wife's visa renewal is in Jan next year.. im thinking of going to a solicitor to get confirmation on this.
I have sent an email to UKBA, but havent heard back from them, it has been a month now.

In the mean time, if you get to know something about it,please do let me know.

Hi,

I had taken advise of a solicitor and they said that its better my wife goes ahead with the tier-1 extn and I go for the ILR next year.
And my wife should apply for her ILR when she becomes eligible.
