If you have applied after 06/04/2013 then you should also submit SA302 for year 2012/13 for your husband. Because the one you provided is not latest.

This is urgent, any advice will be appreciated need some clarification.
Firstly in regards to income, are they looking for 18,600 before tax (gross pay) or 18,600 after tax (net pay)

Secondly my solicitor received a letter from UKBA saying they will put my application on hold because i do not meet financial requirements.
They have not even mentioned my savings? Im sure on the application it says ur income plus savings count towards financial requirements. I showed bank statements of my savings, 6 month wage slips and my p60 with employment contract and employment certificate confirming my job and salary,

What the hell is going on?? Why would they put it on hold??

Sallam: Its 100% Gross income before tax and your allowances.. In regards to saving its bit complicated because it depends how much saving you have and they will divide it by 24 or 30 to work out your pm saving or something like that. Best thing to get pro advice on that.

So for example... £30,000 (savings) - £16,000 = £14,000
Then they will divide by 2 (husband and wife) £14,000 divide by 2 = £7,000

So if your incomes say 13,000 per annum they will add only the 7,000 (regardless of how much you have in total savings)
= £21,000.

Thank u for replies. That makes sense to me now especially about the savings no wonder they have not counted mine. I put down 10 grand but obviously there's no point of that.

I think I'm gonna cry :( why are they being so tight over something so minor and small.

I knw i didnt get it either until sum1 explaind it to me and its pointles hu the hell gna have that much savngs !!!!

Dnt be upset i'm on hold 2 over a bloody petty thing.
Its so heartbreaking, bt be thankful we didnt get instant refusal atleast and everythng in the application is fine in shaa Allah. . . Just got to pray the law changes now.

For savings, the formula goes:

16000 + shortfall of income x 2.5



16000 is the amount of savings that makes a couple ineligible for a lot of benefits and 2.5 is the number of years a first spouse visa is valid, since you have to show that you can maintain your spouse for the entire validity of the visa.

So, if you earn 15000 pounds per year, you need 25k in savings:

3600 x 2.5 = 9000 (to make up the yearly shortfall)

9000 + 16000 = 25000 (to have the additional cushion to keep you above benefit level)

So you applied through a solicitor and he didn't catch/point out that you don't meet the financial requirement because your savings are not high enough to be counted?

I hope you try to get your money back, they are obviously not worth their fee if they are not up to date with the new rules!

Solicitors are a waste of space i still know solicitors that r guiding people wrongly and saying that u only need to provide 4 months wage slips which is WRONG !

Hello all,

I am sorry for all the applicants whoz application is on hold jut becuse of financial requirement. Even who applied through solicitors....you have paid them to do their job.....they should know all the requirement...and even if you apply on ur own HO has very detailed chapter 8 documents on their website that explains all types of income consideration....even the relationship requirment.

Its always better for to read that chapetr thoroughly...cover all mentioned point then apply with a full cover letter...explaining all the requirement points....then hopefully they could not reject...

All the best for all...but please when u apply do read documents....its my general statement...not for any specific memeber please......
