ILR Parents - Child born in India

Post by ILR2013VA » Sat Sep 28, 2013 11:29 pm

Dear Experts,
Need your advice on my case, our baby is due in Jan 2014 (after 4 months), Myself and wife will get ILR In November.

I checked processing times for "settlement " in India is around 4 months or even more.

We are planning to goto India for delivery

What are options do I have if baby born in India? by considering parents has ILR.

I am wondering about processing times, please let me know the best way to bring Indian Born Baby?

I referred few threads already about MN1 etc, but don't understand which suits for us.

Your Immediate answer will be very much appreciated.

Thanks
Venky

See also children.

MN1 may not be possible (for a non-UK born child) until a parent is granted British citizenship, etc.

ILR Parents - Child born in India

Thanks Vinny for your quick reply.

I have below ideas, please share your opinion what do you feel the best option:

1) Applying as Family Settlement for baby and bring here, and later probably after I have citizenship I can apply for her ?? Is it good Idea?
Bcoz my wife also working in UK, so we will need to come back ASAP.
By Considering the processing times for settlement in India, I am thinking about this option.

Or.

2) Though I am from South India, I will go to "Ned Delhi" VFS office to apply for her visa which may take less time than chennai. I will apply ILR for baby? here, what is application I need to fill as both parents has ILR?

3) Can I apply for Citizenship for baby when I apply in next year- here both parents will be applying together?
Or any conditions such as UK Living time, 2 years etc.

Please give me your opinion.

Regards.

Hi Vinny,
I am thinking to apply a family visitor visa for baby and bring here, and later once we have 3-4 months holiday plan in India, then we will apply for Settlement.

Will it impact anywhere? what do you suggest?

Thanks

It may be possible, if baby is not intending to remain in the UK for longer than the leave normally granted to a visitor (up to six months). But it may be difficult to convince them of this.

Venky ,

Giving all this hassle , i would recommend birth of baby here . But if you have solid reasons and time to take up all hassles then you can do it.

Mine is only suggestion.
