Tier1 extension took long time - will delay time be counted?

Hi,

Last year my T1 was due to expire in Apr-11 and I applied for extension in Mar-11 (a month before). But the extension application was approved in Oct-11 (same is the date on BRP).

My question is that during ILR application will UKBA consider time period between Apr-11 to Oct-11 (while I was waiting for extension approval) as valid period towards 5 year stay?

If you made a valid in-time application, then there is no gap or break in legal residence as a Tier 1 (General) migrant.

Hi,

I'll be submitting extension application soon.

Will this be treated as overstay?

Also there is a question in the form:

D8. Have you ever stayed in the United Kingdom beyond the end of your period of leave?
Should the answer be Yes or No?

You have already been given the answer.

The answer is No as you made a valid in-time application.

As far as that question is concerned, tt doesn't matter when your application was approved. All that matters is your status when you made the valid in-time application

You are covered under section 3C. If you have made an application on time then you dont have to worry.

Kannit, may I ask if you applied as Employed, Self-employed or Employed as Director or Limited company?

Not that it should, I am just very surprised they actually took 6 months to make a decision on a straight-forward full-time employed applicant.

OK. Well I think that happened because some part of my earning claim was from India and it took them very long to verify that.
