SPOUSE VISA APPLICATION ON HOLD ..ANY CLUE WHY?

Post by tascopic » Tue Oct 01, 2013 5:34 pm

HO wrote to my wife thus "

" Your settlment application is currently on hold along with other individual's applications awaiting advice from policy. We hope to resolve this as soon as possible.

Please note that your visa application form and reference number for future reference is *****

Regards

Sheffield Visa Section"

I WANT TO KNOW COULD THIS BE BECAUSE OF THE NEW RULE ON FINANCIAL REQUIREMENT OR SOMETHING ELSE DELAYING THE APPLICATION ? BECASUE I SUBMITTED PROOF OF FINANCIAL REQUIREMENT ALONG WITH THE APPLICATION OR COULD THIS BE FOR OTHER REASON
ANYONE PLEASE ENLIGHTNE ME

If you don't meet the financial requirement, that could be a basis for holding your application, but the reason for this shoudl have been specified.

It is not proper for people on this forum to start speculating on the possible reason for the relay.

thank you Obie there was no reason specified for holding it and i am left wondering why. if anyone who has his/her held for financial reason can say if the reason was specified in their own then i ll be able to know the reason is me not financial requirement because i do work and i provided evidence of my work with average salary of 15k per annum and also i have over 20k pounds in saving held for 6 months to add to the specified evidence as well so as to meet the requirement .

if i may as you please, can i ask them to tell me any reason why they are holding it?

Based on what you have just wrote, you do not meet the financial requirement. Is this a new spouse application?

I believe he does. He has a cash savings of 20K which he has held for over 6 months, this can be counted towards the £18600. Furthermore he earns 15K.

Depending on whether the wife earns a wage aswell, that too could be taken into consideration.

You could write to them to provide reasons for their decision, as you case meets the existing policy.

I asked whether this was a new spouse application to decipher whether or not the partner's income (if any could be included) but given s(he) did not mention it, I doubt it.

Regarding savings the £20000 will not be taken into consideration only £4000 will be and that turns into a tariff income of £1600 PA. £1600 combined with £15000 does not satisfy the financial requirement for a couple.

I take your point, that the 16000 will be deducted from the 20k and divided by 2.5.

I guess ex 1 may apply, and any other income received from property could be added.

I concur that on the basis of the current circumstance, he does not meet the financial requirement.

i did include income earned from rental property that i own which amounted to about 4,200 pounds. all the evidences are included in the application. i even started a new job 2 months before the application which pays me about 500 monthly on average as it depends on number of hours i work.

all these is included in the application too. my wife earns about 500 pounds monthly but because she is currently living and working outside the UK her earning will not be considered for the application even though i included it in the application at least to show them the kind of earning potential she can have once she get here

i will email them to specify the reason for the hold as i believe and clearly provided all the evidence needed to satisfy the financial requirement as the rule states at the moment

You'll have to be more specific, the £15k PA job, how long have you been doing that, is it salaried or not and what was the lowest monthly Gross wage slip in the 6 months before your application?

i have been doing the job for 3 years and its not salaried. i get paid based on hours i accrued in the month. the lowest in that period was 1,200 and my last pay slip was 1,800. i opted for option A which find an average of the acrueed 6 month and use the average of 6 month to determine the annual salary equivalent and that is how i come about with 15k salary . and like i said included evidence of saving and also rental payment on my property which when added together clearly qualify me for the financial requirement as it stand

Do you own the rental property outright and do you live in it? I assume you included the title register and rental agreement/contract?

You needed to include a rental agreement/contract and the last 12 months bank statements showing the rental income being deposited.

yes i included the rental agreement and i included bank statement within 12 months showing the rent being paid.

in fact its a joint account with my spouse and its the same account that i have my saving which showed the 20k as saving for 6 months to further proof that i meet the financial requirement

Then as Obie states, write back and ask for clarification.

However, just for clarity make sure the bank in which the savings are held is/is not listed in Appendix P (click) and is regulated by the FCA or equivalent.

can u pls clarify this for me pls

A letter from the employer(s) who issued the payslips at paragraph 2(a) confirming:

(i) the person's employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).

can u pls explain (iii) i would be using 6months payslips so would the letter need to confirm how much my wife has earned 6months prior to my application?
