Hi sumbal read this pleas
tthe statement then goes on to deal with the procedure of dealing with applications under paragraph 134 which Miss Mason routinely deals with. At paragraph 11 she said that some applicants accrue a sufficient period of leave under section 3C of the Immigration Act 1971 whilst the appeal is pending. Those applicants do not need to apply for further leave. When sufficient leave has been accrued they withdraw their appeal and submit a new application for ILR under paragraph 134.

Old address

Post by m_n » Sat Oct 05, 2013 7:48 pm

I have been living on my current address for less than 5 years, so I would have to give details of my last address in the application form. I am not sure about the date that I started living on my last address (lived there for 5 years), I remember the month and year but not the exact date.

Is it ok to write an approximate date and explain in the application?

In my last application I also gave details of the last address, if the dates on my SET(LR) application and my old application do not match, could there be an issue?

Best Regards

Dear asjid73,

Are you sure about this?
What about this paragraph (http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary):

"A person may complete 10 years continuous lawful residence whilst they are awaiting the
outcome of an appeal and submit an application on this basis. Under sections 3C and 3D, it
is not possible to submit a new application while an appeal is outstanding. However, the
applicant can submit further grounds to be considered at appeal.
If the applicant has an outstanding appeal against a decision to refuse leave to remain or
indefinite leave to remain, and submits an application for long residence, you must void the
case and refund the fee. You must create a file or sub-file and mark it ‘PRIORITY’. You must
send the file or sub-file to the presenting officers unit (POU) dealing with the appeal. You
must send a letter to the applicant or their representative informing them their application
has been linked with their outstanding appeal." [Page 25/67 of the Guidance]

Hi Sumbal I am 110% sure, paragraph you cited it says that you can not make new application when you have 3c leave so you can very that application which trigger 3c leave and this is easy and straightforward way and when we talk about 3d yes you cant not make any new application till your appeal is pending once you complete 10 years and withdraw your application you are free to make new application the only restriction is you have to make it in 28 days otherwise its going to be refused and what ever it says about void it will happen if you have appeal pending and try to send new application. The reference i gave you is from a case which was heard is high court and case worker gave evidence that once you complete the period in question you can withdraw your appeal and make new application for ILR and this is normal practice and we deal with it in routine.
My friend send a fax to tier 1 tribunal today for withdrawal appeal, once he got confirmation he is going to send his ILR application to HO i will put his detail on forum once he send his application.
