Hi,

Date of Entry to UK :-

15th April 2008 with Tier 2 Visa expiring on 01 May 2009.Applied for extension with my company in March 2009.A change of employee within the company delayed my application and it was bought to my notice only on 26th of April 2009.

I had so less confidence on my company filing my extention before 01st May 2009 that I left UK on 30th April and filed a new Visa from outside UK.

New Tier 2 Visa issued date August 05th 2009.Back to UK on Aug 17th.

As I would have broken the 28 Day rule w.r.t 5year Continuous Stay, does that mean I will not be able to apply for ILR until next year even though my intention was to make UK as my primary residence . My extension within the UK got missed because of my Companies fault and not mine.

First Entry - 15th April 2008 - 30th April 2009
Second Entry - 17 July 2009 - till

If the 28 day rule w.r.t 5-Year Continuous calculation is not satisfied can it still be applied for ILR with a proof that the candidate was trying to make UK the main residence ?
