Residency calculator and stamps

Does it count from the date you were granted permission to remain in the state or from when garda stamp your passport.

Because i have an issue here which i need an advice what to do.

1.I got permision letter dated 19/09/2008 for 5years under the Eu treaty.
2.Garda gave me an appointment for 28/10/20008 and my passport and gnib card was stamped from 28/10/2008. anybody think this is right?

Again, last week i got a letter to go for a stamp 4 to extend my stay pending my review decision the letter says i will be giving 8months extension from 13/09/2013 the day my application was recieved till 13/05/2014.

But the garda registration officer refused to backdate my stamp accordingly and instead she stamped my me from todays date 08/10/2014.


Moreover she took all my finger prints, she threatening if i refused she will not get me registered.
I am very angry because i knew all these are not right. can anybody please give any advice on what to do?

Dear Shaddai...

The reply post from iluvireland above is total mis guidence , You Time will Start from the Date the Letter was Signed by Justice Minister or the Date Permission on letter was granted , According to the new Law changed January 2013 after Mr. SUlaimon Vs Justice Minister - Brophy solicitors won the case , So i Copy Paste u the Link and u can read it yourself , it is clearly mentioned from the supreme court Judges that the Time will start count from the Date of Permission The Approval Letter was signed :)

as far i know start from date of registration,,,,thats why peoples go gnib office to get record of all stamp they got,,,
any way if you aply then i will know.. best of luck

There was a certain Suleiman case by the supreme court, the court confirmed that residency starts from the signed date on the letter or the date permission was granted.

iluvireland People already start applying Naturalizations from the time start dates when the letter was signed and permission granted...

All we have to do Attach your decission etter with application when u apply Naturalization :)

datebutt thanks exactly that what i meant ... After Sulaiman case everything is changed now , so the count down starts from the date on letter when it was signed or decission made .

last year my friend application did not received becouse of that,,,,
if law changed thats very good news for us

sonia 167:- is that 6 months tem stamp countable for application to make 5 years ?

iluvireland....

I am not quite sure about 6 months but i think it should count bec definately it is visa stamped for 6 months on ur pasport and it is legal residence for 6 months and it should count , u can take advice from solicitor , i am sure it will count 6 months :)
