Please clarify for application

Post by Rajuk09 » Tue Oct 08, 2013 12:18 pm

Hi All,
Just a confirmation , please help,

WP stamped - Nov 2007
Came to UK - Jan 2008
WP to T1 - Apr 2010
T1 to ILR - Nov 2012 (As entered UK within 3 months)

Hope I can apply Nov 2013 (just after the date of my ILR apporval) ? Sorry for this question ,
My confusion is
5yrs in UK + 1 yr ILR
OR
1 yr ILR and total it can be 5 years ? (ILR 1 yr included ? )
I am thinking the second option as I can apply next month, and I was physically present during Nov 2008
or else I need to wait till Jan 2014 ? (this will make it 5 yrs + 1 yr ILR)
Please clarify
Regards
Raj

Hi Rajuk09,

The qualification period is 5 years, with at least most recent 12 months without immigration control.

Yes you should be able to apply in Nov 2013.

Thank you very much InUKOnHsmp for the quick reply. Have some important queries on the documents , please clarify,(I am a director of ltd company)

- Filled Form AN

- Filled Fee form

-Passport

-Letter confirming that I have passed the 'Life in the UK' test

-your confirmation that you met this requirement in order to obtain settlement. (Covering letter ? )

-The Home Office letter giving you permission to remain in the UK permanently (ILR Card ? )

- English Language requirement. Am applying next month (Nov) so with new rules, My Masters degree is getting 10 points in Points Calc , can I show this ? Getting different views on this in here , please clarify

I am Driector of limited company ,so for the following point

-HM Revenue & Customs confirming that you have paid tax over the relevant period.
Is it needed from HM Revenue ? or Letter from Accountant is sufficient ?

- Two references (yet to find)

- Any other document relevant to "Director of a Limited Company" required ?

- Last but not least , I bumped in to a van infront of me , but no casulities , it was so small accident that , just break lights of the van in front got damaged, but my cars bonnet was replaced. And all this was told to Insurance company , and they will deal with it , no police or court involved - Do I need to inform about this in my application ?
Kind regards
Raj

You will need your Unique Tax Reference (UTR) number and tax return or you can ask HMRC to send you SA302. As such only UTR will do.

No need to declare accidents, unless it has gone to court and you were charged.

Thank you very much Neoseal ... SA302 is it for last 12 months ? I am applying next month , is it OK until this month ? And UTR , hope I can get it from my accountant ? regarding English language requirement my path was WP-> T1-> ILR , and get points for my Masters in IT , will this suffice ? Or need to take up test ? Please advice.

SA302 just a kind of Self Assessment receipt from HMRC, you can just ring HMRC and give your NI number and can ask to send last 2 -3 years SA302. As such you will not need any if you have passports to show your full 6 years residence. Only if your passport is expired and you have not renewed it or if there is gap between expired passport and renewed passport then you will need to prove that you were resident in UK during that time. Otherwise you will just need UTR number.

Regarding English requirement, your degree will do, however read thru this forum about what other say on this as I am not sure about it.
