Hi,

Our hearing for Tier 1 Team Application was scheduled on 21st October Monday and we just received a letter today, Friday, stating "considering the additional documentary evidence sent by the appellants, the respondent has decided to withdraw the original immigration decisions and associated Reasons for Refusal letters..". and that they will arrange for the claims to be reconsidered and for new decisions to be made in the near future...???

Any thoughts guys....we appealed and sent supporting letters for oral hearing in may and just appointed a representative in October, a barrister.

Now they have withdrawn the appeal which actually sabotaged our chance as we were prepared for the hearing to win it. our reason for refusal was only " no landline number in contract"

Any suggestions or ideas as of what would happen?? and when would anything happen??

Well ... atleast they responded. At this stage, they can decide to ask you for anything based on their discretion. Make sure that your document are updated and most especially still retain yr maintenance fund.

It will only prolong ur case. I m in the same boat having hearing on 15th next month. My solicitor suggest to send them the docs on the last days, as HO withdraws the decision if they realise they have a weak case. He also told , HO office have started this new gimmick. Withdrawing decision and resending it to the caseworker. Later they refuse it again on Genuinity test saying they dont think u are genuine entrepreneur. This is just an opinion of one person. No intentions to demoralise you. Keep your paperwork ready.

Thanks guys for the information. Its gone back to waiting again for letters. We were confident that we could win the Appeal. Anyway as the hearing did not happen, is there any chance that we get the oral hearing fees refunded? Any idea?

Anyone having progress after their appeal withdrawn?? How does it work if HO withdraw appeal before it happen? Do we get our Fee back for Appeal? How would the HO and Tribunal respond and in what context to the appellant when the HO take their original reason for refusal back? please share your experiences!!
