which rule applies?

Hi,

For ILR which rule does apply to me..not more than 180 Days absence in 5 year period or the new one no absence more than 180 days in consecutive 12 month period.
The reason i ask this as my current company needs me to work at their overseas branch more often. Could I benefit from the new rule or for me the rules at the time of entry clearance apply?

I have already been absent from UK for 85days since March this year for oversea assignments and the company wants to confirm if they can send me again in this year.

My Visa details-
Entry clearance stamp : 1st Sept 2010
Entered UK : 23rd Oct 2010
Got Extension till : 1st Sept 2015.

Planning to apply ILR in 1st week of Aug 2015.

since Dec 2012, ILR SET(O) applicants should not have more than 180 days absence out of UK per 12 month period in their calculation of 5 year break up preceding the date of application
