Hiya Everyone!
I am planning to apply for a Tier 4 Dependant visa in Feb 2014.
My husband, who is currently studying ACCA with a Highly trusted sponsor institution.
However, next year, he wishes to change his Tier 4 sponsor and opt for a University status institution instead, for his remaining 6 ACCA papers. He will get his visa for more than 12 months.
Will he be able to sponsor me as his dependant once he receives his extension?
Also, would I be able to work being on Dependant Visa?
Sounds like a basic question, but I am slightly confused from the information on the UKBA website.

For you to be eligible, you partner would need to be studying at level 7 withh a HEI. You have not confirmed that in the message you have written.

Yes. ACCA is NQF Level 7.
And he will take admission in Birmingham City University.
He will easily get an extension of more than 12 months.
Apart from these, what would be the maintenance requirement if I apply after he gets his extension? Would he be considered for 'established presence?'

ACCA:
From paper # F1 -- F9 which is equivalent to BSC degree is NVQ level 6. The stage beyond to F9 is NVQ level 7.

Yes, he has finished upto F9. F8 is left, which he will complete in Dec 2013.
So, he will apply for extension for papers beyond F9.

Your question is confusing. His maintenance (at the lower threshold) is contingent on him having an established presence (as defined). Your maintenance is based on his presence in the UK for 12 months or more but that is not the same as an established presence (as defined).

I have another query regarding my husband's ILR.
As soon as my husband gets his ILR- Long residency approved, can he sponsor me on Spouse Visa (me applying from outside the UK) if he fulfills all the other requirements?

Ok.
From what I have read on the UKBA website, I have learnt that when my husband will apply for his ILR based on 10-year long residency, he will first get Leave to remain of 2 years. Would he not get ILR straightaway- why?
Is this correct?
Can he still sponsor me on Spouse Visa (Me applying from outside the UK) if he gets Leave to remain as I mentioned above?

I m in uk for last 3 years as depentnt, but as my wife finishes her bsc we applied for acca for one year. But as the dependant I didnt get any work rights when checking the cas i realized couse starting date and ending dates are 10days less than one year.can some one pls advice me wather I could change this status. Coz we got the cas only for 4 subjects she got 2 exception coz of her bsc. Still more to do.is there is any way I could get my work right s.pls advice.many thanks

There is no way to change this. You were only granted further leave as a dependent because you benefited from the transitional arrangements as currently for non sponsored students whose dependants are applying for the first time they can only bring dependants if the course is plus 12 months. As such you were granted further leave as you were ready here as a tier 4 dependent but not given work permission as this was the position for dependants of students studying for less than 12 months prior to the major change in dependants rules in 2011.
