Debt and revocation of Citizenship?

Post by TANGO2013 » Wed Oct 23, 2013 4:26 pm

Hello

Please can I ask if having debts could result in the revocation of citizenship. I am planning on moving abroad for a while,so want to know in what circumstance would the Brit Passport be withdrawn. Has there been any precedence? No CCJ yet but defaulted on some payments.

Thanks

Having debts will not revoke your citizenship, however running away from creditors may be classed as fraud or criminal activity especially if creditors file a complaint.

British citizenship is a privilege not a right, so you can loose it in extreme case.

Thanks for the response.

I do understand its not a right. I would try as much as possible to pay the debt but I just do not have the means. Plan to go take up a job in another country and hopefully pay up the debt. Just not sure if been out of the country could mean the loss of citizenship? Do have an idea as to how long before it can be classed as Fraud or a criminal activity?

It may not be classed as fraud at all if creditors do not log formal complaint. However its going to have significant impact on your credit rating. If you don't mind me asking, how much is the debt and for what?

Its a debt of about 10,000 on credit card and overdraft.
Just fell on bad times. Lost my job and had to pay rent and bills. But no excuse,so thinking of going in search of jobs elsewhere.

Just received a court form from Northampton as regards a debt. How bad can CCJ get. Can I be allowed to make small tokens and have the debt frozen with no more interest?

If you are struggling to pay your debts you should seek free, impartial and confidential advice from the National Debtline or Step Change or your local Citizens Advice Bureau.

Ok so you have already received CCJ form, you can still contact all credit card company and bank overdraft and make an arrangement to freeze interest and arrange a certain fix monthly payments. This way you will not have CCJ. Even if you have CCJ its not worse thing to have, however borrowing in future will be difficult, especially personal loan, mortgage etc.

If you think that there is no way you will be able to pay off the debt, then you can go for Debt Relief Order (DRO), you will get more information from Citizen advise bureau. Since recession kicked in, this is government scheme that debt upto £15000 will be written off. More details here

A DRO has quite strict criteria to be eligible, I suggest you contact the National Debtline, they are also authorized to act as an intermediary for DROs.

Thanks both for the advice. Really ashamed of myself but guess its not an isolated case. Really had all good prior to geting my BC but funny enough it all went gaga after.
Guess I just make a call and see what can be done. I am certain of been employed/engaged in Biz in my home country but do believe there would be a bedding in period before I can start servicing the debts fully. Just a bit worried that the citizenship could be withdrawn.
Thanks once again for the advice..
