Dear all,

I am a Tier 1 General visa holider since June 2009. I'm targeting to submit my ILR applicatoin in May 2014. I'm trying to claim my previous earning period will be between 01 May 2013 to 30 Apil 2014 (total 12 mnhs).

Issue generated:
However I just saw this new version Tier 1 (General) Policy Guidance version 10/2013 Page 15 of 35 (http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf ), and it mentioned:

86. We will only consider actual earnings. We will never consider
earnings claimed on pro rata basis (for example when you
have worked part-time and try to claim for what you might have
earned if the work had been full-time).

Question: my salary could be counted or not?

As to my new job started from March 2013 to present and based on shift work type, above regulation makes me concerning if my earning is able to count it or not. My monthly salary payment is based on 4 weeks basis to my bank account as a permanent full-time staff. I got payslip every 4 weeks. I worked more than contract hours weekly. Payslip clarly shows n.i. contribution and P.A.Y.E.

You can claim your salary. pro rata is not relevent to you.

As long as you earned the required income in any 12 months within the last 15 before the date of your application. It is fine
