ILR Eligibility - Less than 5years stay - Query

Hi,

Tier 1 ( General) - Visa started on 11th Dec 2008
Arrived on 12th Feb 2009
Applied for extension in Dec 2011
Visa Extension received on 9th Feb 2012
Visa Expiry on 8th Feb 2014

So, i will finish 5yrs to eligible for ILR by 11th Feb 2014 but my visa expires on 8th.

Am i eligible to apply for ILR and if YES then starting on what date can i book appointment for ILR to appear in person ?

Your advise is much appreciated. I have heard a lot about immigration boards from my friends.

I am aware of that. My questions are

1) Are you saying that I am still eligible to apply even though my visa expires before a total of 5years ??

2)Qualification period would be 28days before 8th Feb ( Visa Expire) or 28days before 5yrs period ( 11th Feb) ??

Are you sure? I believe you are saying that because by Visa date started on 11 Dec 2008.

But my understanding is that it doesn't matter how long you have the visa but what matters is your length of stay in UK. I arrived here on 12 Feb 09[/i]

The period between entry clearance being issued and the applicant entering the UK may be
counted toward the qualifying period, as long as it does not exceed 90 days. This can occur
if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed
90 days, it will not be counted as an absence.

Last Question :

If i book a premium same day appointment can i reschedule it without losing the 100£ fee ? I couldn't find any info regarding rescheduling or cancelling the appointment on UKBA site

If you change it early enough you won't lose the fee. However, the UKBA/UKVI now requires full fees to book appointments, so I'm not sure whether you would have to pay full fees, if you changed, perhaps look at their FAQs or contact the UKBA/UKVI.

1. You can reschedule but if it is more than 5 working days gap then same money ll be transferred for your rescheduling.

2. otherwise £100 you ll loose... and rest of the amount ll come back to your card after you send an e-mail to UKBA for refund and it takes 28 days

3. So you need to repay the whole amount again for the cancel/reschedule...(According to HOME OFFICE Customer service )

4. If cancelled you ll follow the step 2 also..
