Hi there, I am new and like to know about ILR based on 10 years. I came UK in September 1997 as a student then got WP in july 2004 and I am completing my 1o years in september 2007. So my question is when can I apply for ILR, what documents do I need in order to support my application. Also how can I apply for my dependants who live here with me. My wife came here 2 years ago as a dependent and child born in the UK. I never got visa for child beacuse did not go out side the country till now but planning to go after my ILR.

Should I go to HO myself or better to send in post?

You apply for no earlier than 28 days prior to the date your first visa was issued. For example, if your first visa was issued on 28/02/1997, then you can start applying on 01/02/2007.

As for documents, someone here better informed will reply.

My first student visa (Entry clearance) issued on 22 sep 1996 from dublin and then i came here ON 24 Sep and I sent my passprt to the HO for extention after a week and I got my passport back in Jan 2008. So my question is can I still apply on 24 Aug 2007 or wait until jan 2008.

Your two statements above do not hold. Which year exactly did you enter the UK with a student visa?

Assuming it is 24 September 06 then you are already due for ILR based on the 10 - year rule (because of your SV and WP combination) but if not and it was 24 September 07 then you would have to wait 28 days (As pointed out by Sunnyday) prior to the anniversary of the first entry to the UK and not the date it was issued in Dublin to apply for ILR.

I guess you can do the maths!
