Spouse Visa Help

Hello
Would highly appreciate some feedback.
Here is my situation
Kenyan national,came to the UK on a student visa(Due to expire in October2011).Due to financial difficulties dropped out of Uni.Recently Got married in Jersey and didnt require a COA,as i got intouch with the immigration board there who sent me an email confirmation to go ahead with the marriage.
I am considering applying for a spouse visa on the premium service.Is there a need to get a solicitor to do this for me as i am worried of my non attendance according to the visa i have.
Please help with any advice or experiences accordingly

Professional help would be advisable as you may well have a problem switching to FLR(M) due to the non-attendance.
You may get away with this in a postal application, but stand very little chance if you apply in person at a PEO.
Worth instructing an OISC registered immigration advisor before you submit the application.
As a Kenyan national you will be subject to the new A1 test before applying for FLR unless you hold a Batchelor's degree taught in English.

I am just wondering if its worth paying a solicitor to make the postal application or just advice them incase? Dont they check with the university of the attendace?
I am booked at doing my English test by end of month

When was your student visa issued? Did you have a CAS or a visa letter?

My visa was issued in September 2007 in form of a stamp sticker on passport, hope this helps

A simple police caution should be a mandatory refusal for 24 months under the general grounds for refusal. However, some people have been successful before this time has lapsed. Though this may be due to caseworker ignorance. Another option would be to extend until the caution has lapsed.

Is it possible to still use my appointment at PEO and instead lodge the Spousal extension instead of SET M?
Will I also need to inform them why I will be doing so?

Just wanted to update on my query!
ILR was refused on the general grounds as my caution is active until next year.
However on the bright side,they automatically renewed my spousal visa for a further 2 years.Not the outcome i had hoped but it was a silver lining

I am sorry you were refused, however, on the other hand I am glad the rules are being adhered to so that others know where they stand. You should be eligible once 24 months has lapsed.
