Hi All,

Let me explain my current situation first and then I will ask my questions!

I have been in the UK for 3 years now as a dependant.
Current Visa: PSW dependant expires Jun-2014
I work full time for a UK company and my company is willing to sponsor me.
I am planning to switch my visa into Tier 2 general as a main applicant, for that I need to go to India and apply for the visa.

Here are my questions:

1. I am planning to go to India during Mar/Apr 2014 i.e. 2/3 months before my current visa expires, whilst I am in India during the visa process - is it ok to continue to work from there for my company on UK payroll?

2. Is there any other things I need to be aware of?

3. Is there any premium service from india so that I can finish the visa process quicker?

1. If you are not inside the UK there is no restriction on working for an entity that is based in the UK. That is not an immigration issue.
2. The visa could take some time to be issued.
3. In India in particular, I think those services are only for visit visas .

1. One more thing I want to ask is...when I am away in India for visa, my wife and daughter will be staying in the UK as their visa will be valid till june-2014.

Will there be any issues regarding this?

a dependent partner of a Tier 4 migrant can switch within the UK....then why cannot a dependent partner of a PSW can switch?

3. Do I need to do any English language test?

1. No there are no issues and your wife and daughter can continue with valid leave to remain.

2. Good point. Not sure what is the logic behind allowing a partner of Tier4 whereas not for Tier1.

3. You don't need to take a English language test, if you

hold a degree that was taught in English and is equivalent to a UK bachelor's degree; or

This you can verify by entering your degree in the points based calculator.

Regarding point 1 - Thanks for confirming that its not an immigration issue, but will there be any problem for my employer?
