So the HO say in the 12th hour they only received the documents for tomorrows JR, this afternoon and they need time to prepare their arguement.

They intend to drag this out for ever as they know that when and if it get to JR they will lose.

For the HO to lose, will be a massive embarssement to the government and will see the Minster of Immgration lose his position, for botching this bit of law.

HO is counting on the hearing of the JR to be dragged out for a few months by the time most HSMP holders would have come up for FLR and would be deported. So even if the JR is successful, in effect Home Office would have achieved its objective of deporting a large no of HSMP holders

Does this mean the JR hearing scheduled for 14th-15th is going to be postponed ? How can this be allowed to happen. Does the Judge not understand delaying tactics ? I'm sure people try and pull this one all the time.

I thought we were moved form a March date to June date due to unavailability of some court clerk :shock:

Yes it has been postponed and the next date looks like the 18/07/07

This is as I said HO trickery and they will try and postpone as often as possible, just to evade the inevitable outcome, which they already know.

The VBSI site says that the next hearing would be on the first "available" date after 19th July, hence it is uncertain. It is pity that a case on which many families' future depends is not taken up urgently.

At least one thing that comes out is that the Home Office have sensed that their case is weaker and are trying to avoid the face-off for fear of defeat.

One thing is certain .... the Court will not look at this issue under the watch of John Reid as Home Secretary, given that he ceases to hold that position on 27.06.07 when Tony Blair steps down as PM.

So this is now an issue for the new Home Secretary, as to be determined by Gordon Brown.

Home Secretaries never seem to last very long do they? If a PM wants to get rid of someone in a hurry the logical solution must be to promote them to HS..

The BBC news hinted it may be Jack Straw again (And Alistair Darling Chancellor of the Exchequer).
