hi,, i am living in since 2004 and married with EEA national in april 2008 and got EEA FAMILY MEMBER VISA IN june 2009,and we have one baby born in feb 2009. now we are not together , divorced in oct2013.

i have no clear picture wat to do next .
since we were together she worked untill the baby born but i am working full time and paying tax&ni. i have the proof of address together approx. for 18 months. advice me what i can do ...

A person who ceases to be a family member of an EEA national who is a qualified person or who has acquired permanent residence on termination of a marriage or civil partnership will retain a right of residence if:


1.) the marriage or partnership lasted for at least three years immediately before the initiation of proceedings for divorce, annulment or dissolution,

and

2 ) the parties to the marriage or civil partnership had resided in the UK for at least one year during the duration of the marriage or civil partnership,

or

the former spouse or civil partner of the qualified person has custody of the children or a right of access to the children in the UK

3 ) EEA national exercise treaty right before divorce finalised ( 4/6 months )



You living in the UK since 2004 ( as what ? )

EEA family permit or EEA2 resident card in 2008 ?

What was your ex wife doing after Feb 2009 ?

Was she on maternity leave from the employer ?

Did you guys have Comprehensive sickness insurance from Feb 2009 ?

and what was your wife doing before divorce finalised / when you received decree absolute ?
