Tier 1 General varied to ILR during Appeal

Hello,

11/03/2013 - I initially applied for Tier 1 (General) extension.
16/04/2013 - Tier 1 (General) extension refused.
26/04/2013 - Appeal submitted to AIT.
18/06/2013 - I submitted a 10 Years ILR as variation of Tier 1 (General), thanks to the marvelous guys on this forum. This is, including Section 3C i.e. time waiting on processing or appeal, 6 yrs as Student + 2.5 yrs as Tier 1 (PSW) + 2.5 yrs as Tier 1 (General).
03/10/2013 - Substantive Appeal heard but HO requested adjournement to reconsider the case as they didn't have time to consult the appeal bundle.
23/10/2013 - Contacted local MP to clarify with HO what's going on with my case.
30/10/2013 - 1st Case Management Review (CMR) Appeal heard. Unfortunately, HO didn't turn up. Judge gives directions to HO to review the Tier 1 (General) case, make a decision on ILR AND turn up on 28/11/2013 for a 2nd CMR Appeal hearing.
01/11/2013 - Received letter (ICD3207) from HO confirming that Tier 1 (General) Appeal and 10 Years ILR have now been linked together.
06/11/2013 - ILR Applications fees of £1,051 refunded.

So I'm now technically awaiting for 10Yrs ILR decision. Therefore, if my understanding is correct, SkyDrive should show

APPLICATION SENT - 18/06/2013
BIOMETRIC DONE - 08/07/2013
Indefinite approval letter - No feedback yet
Passport & Documents - No feedback yet
BRP - No feedback yet

Positive sides:
No gaps, No overstay of 28 days, No extended holidays of more than 180 days, No excessive time of 540 days spent overseas, No Breach of Conditions and No Convictions. Also, Owner and Company Director (1-5 staff members) . Annual Gross Profits in excess of £100k. Company active since 2009.

Negative sides:
I started JR action against HO twice and won appeal 3 times. Basically, I could potentially be perceived as a pain in the back side from HO perspective...

Potential complications:
UK Born not included in any application at all. Non-UK born dependants not included in 10Yrs ILR application because there's no provision in Immigration Rules. Therefore, they're technically still waiting for PBS dependant appeal decisions which has been varied to ILR as per above statements.

i changed my address using online service week ago.i received auto reply as well that it will take 72 hour unless-----.how i will know that my address has been changed with them.do i need to follow some other steps, please let me know

I think a measure the home office should implement is an online status of applications. It would make things so much easier e.g.
Allocated to case worker
Under consideration
Etc...

Absolutely.

There is a survey going on now. You will get link to it after getting ILR in the letter from HO.

We should all fill it and demand on-line application tracking like in US. For future applicants, this would be a good deed. :!:

it is a good and they should start that because every financial year they speedily increasing application fees so they must improve too.

Strange none of the October applicants got their biometric invite yet. The trend is usually within 4-5 weeks isn't it? I know in some cases it takes longer.
Any October applicants got bio yet?

Change your address online? Is this for ILR application or something else?

I received my biometric 15 days after I sent my application. I applied back in August.

Finally got my ILR. My case was straightforward. Been here on 2 years working holiday, 3 years student, 2 years post study visa, 3 years work permit.

Paperwork Send:
P60 - 10 for each year
Passports
Employee letter (current and previous)
3 months payslip & Bank Statements
Life in the UK test

My time line is:

APPLICATION SEND - 13/07/2013
BIOMETRIC DONE - 5/08/2013
indefinite approval letter - 14/11/13
Passport & Documents - 16/11/13
BRP- Still waiting

Guys can any one please suggest ,
My situtation
I varied my application to 10 year set LR on 12/11/13 from tier2 application
But very next day after varying i received my approval of my tier 2 application and received my documents back from tier 2 departmet as well.
Fee for set lr taken and yesterday i have received the acknowledgement letter from ilr departments as well
Question is
1: should i send my passport and supporting documents to ilr department or should i wait Cw to requet it first
2: if i should send my documents/ passport to home office which address should i send it to , durham or liver pool as this is the address they mention on acknowledgement letter or lunar house london
3: i am leaving my job on which i got my tier 2 visa end of this month, is that mean my tier 2 and my wife tier 2 status will be invalid after i left? Should i apply for flrm for my wife or should i wait for the outcome on my ilr application ( more likely 6 month wait)
If u suggest i should wait for my ilr outcome before applying my wifes's flrm will her status be legal after i left my job and the time she spent waiting for the result of ilr?
Guys plz suggest me i m trying to do all without any solicitor as this forum have been so helpful and my only hope to get guidance is through this forum , hope u can understand how delicate this scenario is for me

By the special grace of God Almighty maker of heaven and earth, my ILR BRP arrived today finally! I guess my passport and supporting documents will soon be delivered. Can someone please update this on skydrive.

I was very worried that I'll be rejected because there was a time my tier 4 extension application was sent back to me because I sent passport photos that didn't match the requirements. But God took control!

Docs I sent were:
Tier 2 BRP
Passports
Life in the uk
Bank statements
Degree certificates
Letters from landlords
Personal statement

Yes, you can send it to them and also wite a covering letter on what happened and do mention, now that your Tier 2 has been processed you want to go ahead with the SET(LR) Application.

I'd suggest you to wait as there is a chance for your wife to get ILR without having to make FLR(M).

If u suggest i should wait for my ilr outcome before applying my wifes's flrm will her status be legal after i left my job and the time she spent waiting for the result of ilr?

After i left the job do u think my wife's tier 2 dependant visa/status will be automatically become invalid as her visa is obviously based on my job , so in other word if she has to wait 6 month to get result for my ilr application ,
would her time spent waiting consider a legal stay?

I have read through the pages mention in above link, didnt quite get them :roll: is my understanding right the safest way would be to apply for her FLR (M) now, in the guidance they mention about using discretion when dependant child is 6, we dont have any children so not sure if they could apply discretion
in her case ,

I am new to the forum. I have submitted my 10 yrs Long residence application on 20th September 2013 and received acknowledgement on 26th September. I haven't received a biometric letter yet. Please can anyone share your experience if you have or haven't received biometric letter who has submitted more or less in the same timeline. Your response would be much appreciated.

If you cannot stick with your current employer until you get your ILR then yes FLR(M) is the right option. Tailor this template to fit your purpose and then leave your current employer.

Finally after a lot of delay got my Biometrics letter yesterday! I had to call HO on Friday and request a second biometrics letter. The lady told me my letter was sent out on 10th Oct and because it had been over four weeks, I could request another one.

Application Sent: 20/09/2013
Payment Method: Credit Card
Acknowledgement letter: 30/09/2013
Biometrics letter received: 19/11/2013
Biometrics enrolled: 20/11/2013
Approved Date (On Letter): TBC
Passport/Approval Letter Received: TBC
Biometric Card Received: TBC
