Switching to PBS dependant visa

Dear all,

I am on Tier 1 entrepreneur visa and my wife is in tier 2 general visa. I want to switch her visa to my dependant. I searched everywhere to find a right answer if she can apply to be pbs dependant from here or not. But I haven't got any satisfactory answer.

Some people said as the immigration rule changed on 1st October 2013 any one who is not a visitor or in temporary visa can apply to be PBS dependant. I am worried that if I applied and the visa gets rejected then she will have to go back and apply.

Any suggestions or thought on this will be very helpful.

@ angelStha, yes she can apply from UK as your dependant.

@ angelStha, check the PBS dependant policy guidance and application form and you will see all documents that you need to submit with the application.

That form if for outside the UK, I believe you must use the online form system to apply in the UK.

Thank you guys for the link. However my confusion is the application form only asks for marriage certificate, council tax and utility bill in joint name and financial statement covering maintenance for 90 days. These documents I already have.

My question is do I need to show where I am working, my payslips and my wife's letter of employment and payslips??

@ angelStha, since you are now on Tier 1 entrepreneur visa, then you should not be working for another company as an employee, so be careful about submitting your payslips or employment letter except if they are from your former employer. But you can submit your wife's employment letter and payslips as additional documents.

The most important thing for you to submit is your proof of accommodation and also maintenance funds. Try to submit maintenance bank statement with enough funds to support your wife.

Regarding accommodation, currently we (me and my wife) are living with my sister and we do not have name in council tax or tenancy agreement. I contacted the council to put out our name in council tax letter but they said if we are not in tenancy agreement they cannot add us in council tax letter but they said they have put our name under additional occupant in their system.

I am planning to get letter from my sister confirming we are living with her as it is 3 bedroom house this should not be problem or will it be??

To show we are living together for past few years I have previous council tax letter and utility bill.

Also, do I need to write covering letter for my wife? If yes, what do I write in it? Is it I will be supporting her for her stay in UK and she will be living with me?

Maintenance Fund

I am preparing required documents for my wife's application. One thing I am worried about is maintenance fund. can I show maintenance fund in her name from bank account which is overseas?? Or does it have to be from UK bank as she has been living here for past 7 years?

Any response would be highly appreciated.
