Appeal and Reapply for UK Tier 1 (General) Dependent

Hi All,

I am in bit confusion. I applied UK visa for my wife under Tier 1 General Dependent and it get refused due to lack of evidence of relationship they actually mentioned very stupid questions and I know I can easily win the appeal. I know that I have to pay full fee again if I reapply the visa.

My question is, if I appeal and reapply her visa under same category (which we can do at any time despite of outstanding appeal?) and If UKBA issue a new visa for fresh application and we win in appeal also then will UKBA will return my visa fee or not?
