A question regarding child benefit

Hi,

I have been on a spouse visa in UK since November last year. My daughter is now 8 weeks old and I have the child benefit form in front of me to fill in but my husband said to ask on this forum before we do.

One of the conditions is not to take any benefits, so are we eligible for this?

And should I be filling in the form or my Husband (he is the UK national).

The child benefit needs to be in the name of your husband (settled/British person) tax credits in joint names.
