SET M qualifying period

I was granted spouse visa (via FLR M) within the UK. i.e I was already in the UK on Tier 1 visa when I applied for spouse visa.

Spouse visa granted on 09 Jan 2012 and expires on 09 Jan 2014. I have booked an appointment for In Person SET M application for 13 Dec 2013.

I complete 2 years on spouse visa on the date of expiry of visa. So 28 days before that, am I eligible for indefinite leave and hence eligible to use SET M?
