thanks for replyVR wrote:hellojohn,
In England a Conviction is a Conviction from the time of the conviction to the deathbead. They do not distinguish between a ''Good Convict'' and a ''Bad Convict''. You carry the stupid record for life.
Creating underclasses and reading the rule book is ''British passtime'' even as many enter the borders without any checks after committing genocide and henious crimes. One was recently serving as an advisor in the NHS.
Coming to the point. The change to the law as far as Naturalisation is that you need to disclose both spent and unspent convictions. Your sentence was spent under the Draconian Rehabilitation of Offenders Act 1974 (which in reality should have carried the name Destruction of Offenders Act 1974). You should be fine, so long as you disclose on your form. But if you do not disclose, they could well ban you for applying for 10 years and accuse you of deception.
Good luck

thanks amberAmber_ wrote:It is also worth noting that a caution for theft in your case which was given 8 years ago when you were aged 18+ will be filtered from Standard and Enhanced DBS certificates after 6 years. Such 'protected' cautions and convictions should be deleted from the PNC after the time has lapsed in my opinion (as what happened prior to 2006). However, this was not addressed by the Supreme Court this week, which I was shocked at.
Hellojohn,Amber_ wrote:Yes, it's not deleted from the PNC (which the Home Office will see) it's merely filtered from DBS certificates. Therefore, you should disclose it on form AN, for employment related applications, you can tick you have never been issued a caution or conviction.

For conviction use 3.6 and for caution/reprimand use 3.10

For employment you can answer no to the questions regarding cautions and convictions.
