hi i have my hearing next month and i am going through well stressed because now i can see loads of tricks been played by home office after winning appeal they are asking for bank bank letter again.....my question is can we switch the category to tier 1 to tier 4???
one of my friends told me you cannot and i am well stressed now
please help.

I believe you are allowed to make a fresh application in 28 days after your appeal has been dismissed.

any reply for switching? from tier1 to tier 4?

you can only switch while the application is awaiting decision. appeal means you dont have an outstanding application that can be varied or switched. however if you are eligible otherwise, you may apply with a fresh application for the same or different category.

i didnt got your point of clarification.........you said i can switch while my application is with homeoffice and waiting for decision......and i can not switch while my appeal is due? ok what if appeal decision is negative? what are the chances to change the category? many thanks for your time

If your appeal has been dismissed you can make a new application same or other category in 28 days but you will not get an another appeal chance again.

I know that you can vary/switch your application while decision of your application is in pending and you cannot make any application if your appeal is in pending
what i don't know is whether you can make application for ten year stay once your appeal is rejected but you complete your ten year legal stay before getting the decision of appeal..anyone?

youneed to understand the difference between apllication awaiting decision and appeal on a decision of that application.
