Hey Venky .. I am afraid I am not able to comment on your case. If I was in your position I would have possibly involved my local MP by now as it has been more than 6 months.

I know some people on this forum have been waiting for more than 6 months but most applicants get theirs in 6 months. Sorry couldn't help you much ..

I've called HO several times and got standard reply i.e. first they said its not been completed (means not assigned to a case worker) then we are dealing with application from Aug-13.

I called today and been told its under consideration and was assigned to case worker on 1st of October -13, but the process is not complete and they can't chase the case worker b4 06 months.

its been 3 months, my case is straight forward ( wat i beleive) no overstays or Criminal convictions. Had 2 speeding ticked but should nt affect my case.

previously : 5yrs student, 2 yrs PSW, 3yrs Tier1.

My friend who applied in October -13 got his back in november 13. Lucky guy han,

help please!!!!

Post by ukvisaengland » Mon Dec 16, 2013 11:28 pm

I came to the UK as a dependant of my father
I had my visa exempt diplomat from 03/01/2004 to 03/01/2008. I entered the UK on 12 Mar 2004. I was studying on that time.
on Jan 2004 I applied to switch from diplomatic visa to student visa as I was studying at the university. I sent my visa application through the university.
I was advised to withdraw my application otherwise they will refuse my application as It is not allowed to switch from diplomatic visa to student visa in the UK. I withdrawn my application and as soon as I got my application back I went back home to switch my visa. I left the UK on 24 March 2004. I was advised that Although the date of this Exemption expired on 3rd Jan 2008, this type of permit allows a 90 day extended period of leave for the person to prepare to return home. I left the UK on 24th March 2008, which is within this 90 day grace period.I switched the visa in my country and I came back to the UK on 18/04/2008.
since then I have been extended my visas in the UK. the total days outside the UK so far 314 days and I have never been more than 2 months outside the UK on one time. I dont have any court fees or any other issues.
Can I apply for the 10 yrs visa??? I dont to apply and visa get refused
this what they have written in Long residence and private life
guidance on the Immigration Rules.

Time spent in the UK exempt from immigration control must be counted as lawful residence. People exempt from immigration control include diplomats and members of the armed forces.
Deemed leave
Deemed leave is the 90 days a person is given once their exemption period from immigration control ends. By the end of the 90 days, the person must either
 submit an application for leave, or
 depart the UK.
A person on deemed leave does not receive an endorsement on their passport.
If a person submits an application to extend their stay in the UK within 90 days of their exemption ending, and is later granted a period of leave, their continuous lawful residence is not broken.
If a person remains in the UK, and does not submit an application for further leave after the 90 days deemed leave, their continuous lawful residence is broken.
For an example of time spent in the UK while exempt from immigration control counting as lawful continuous residence, see example 5 in related link: Examples of continuous lawful residence.
Effect on continuous residence
Continuous residence is not broken if a person:
 leaves and then returns to the UK during a period of exemption, and

continues to meet all other requirements of long residence, set out in paragraph 276A(a) of the Immigration Rules.
If a person leaves the UK following the end of their exemption and during their period of deemed leave, continuous residence is not broken, even if they return to the UK after their 90 days deemed leaved has expired. This is providing that they meet all the other long residence requirements in paragraph 276A(a) of the Immigration Rules.

I appreciate your help and advice

I have applied on 11.11.2013 and payment taken on 13.11.2013, and also received acknowledgement letter but that was no use...

Don't know what to do... I guess i need to keep calling HO untill someone can seriously do something...

Hi all.
Could anyone update Skydrive for me as I have just got my biometric enrolment done.

Biometrics letter: 13/12/2013 (dated 10/12/2012) Royal Mail 2nd class
Biometris Enrolment: 14/12/2013

On the side note, I had to drive 12 miles to the nearest Post Office due to strike action which means that the one close to my town was closed this morning.
Again, I would strongly advised anyone who has been waiting for biometrics letter for more than 4 weeks and who has proof that their payment has cleared to contact the HO as their application could be stuck unecessarily somewhere in the HO as was the case with mine.
Best of lack to all. I can now wait for as long as it takes (been waiting more than 11 years so few more months won't kill me... lol!)

Can someone Advise me What to do ?

I had a leave till March 2016, As i completed my 10yrs i applied for SET(LR) on 11.11.2013. I received acknowledgement on 13.11.2013 also money left from my account.

Suddenly from now where my employer pop in the story. As a annual review/audit of employee my employer wanted to see VISA/Passport Original

I send them the copy of my passport/Visa which is till 03/2016 and also Acknowledgement letter.

Today my employer invited me for me meeting and said, they inquired from HO about my Acknowledgement and HO replied we have no info on that reference. Also mention to them that it takes sometime to get into there system as it has not uploaded into HO systems etc etc...

My HR said, there try to do validation on copy visa in the mean time but in worst case i need to request my document back from HO.

Any Advise experts pls ? ? ?

Thanks in advance

Hi Sadiq,
I agree with RANA-ALI that although the HO has their internal processes; it seems not all their staff are up to speed or willing to help as much as they could. I was in the same situation with you with payment taken out of my account and acknowledgement letter sent to me. Yet when I rang to enquire about biometric letter, I was told there was no record of my application on their system and that I should wait as time for dealing with application is 6 months. That left me not satisfied and while reflecting on the whole situation I recall a conversation I had with another HO Officer on 25/11/2013 (general enquiry about application process) and the Officer advised me that after payment is cleared, biometric letter should be sent out within 4 to 6 weeks of application receipt date.

I then decided to ring again and put my case forward that I was not requesting a decision on my case and only wanted biometric letter to be sent out to me. I must admit that the gentleman I spoke to on that day was really helpful and knowledgeable. After getting all the details he advised that there was something amiss as I should have received biometric letter and stated that he would be sending an email to a certain deportment and that I should expect a call back from them within 48 hours. Indeed, a lady rang me the following day and stated that my application had now been uploaded and that a biometric letter had been sent out to me that very morning (I received it about 3 days later as it was sent by RM 2nd class).
I would suggest you give it a few more days and if you do not receive your biometric letter by 6th week, please call and explain your situation with the hope that you will be connected to someone helpful (that is very important). Wish you all the best.

PS: sorry for not responding earlier but my work is just driving me crazy at the moment (high case load).
