Confusion over dates! Urgent Pleas !!

Hi,

I have received my ILR on 14/12/2012.
Now I have booked an appointment on 17/12/2012 ( TUE) through Hillingdon NCS.

I have just read the following rule.

1. You must have been physically present in England, Wales, Scotland, Northern Ireland, the Isle of Man or the Channel Islands on the day 5 years before the application is received by the Home Office.

For example if your application is received on 20/1/2010 you should have been physically present in the United Kingdom on 21/1/2005.

Most applications that fail do so because applicants have applied even though they cannot satisfy the residence requirement to be present in the UK at the beginning of the residential qualifying period.2. You must not have had more than 450 days outside the United Kingdom


I have left UK on 22nd Dec 2008 for Egypt.

So what I understand is if the UKBA receives my application by 20/12/2013( Friday), I am eligible according to this rule. Or else I am not eligible.

AM I correct ?

Sudhibabu,

You are submitting your papers on 17/12/2013

Minus 5 years from this so you should have been in UK on 17/12/2008.

You left UK for Egypt on 22/12/2008.

Legally the date the UKBA has received the application is 17/12/2013 as soon as your application is checked and the NCS receives it to be conveyed to the Home Office.

So you should be fine.

It's actually -5 years + 1 day so the date in question would be 18/12/2008 in VR's example assuming the Home Office received the application on the 17/12/2013. Also it is not when the application is submitted (unlike immigration) it is when the application is received by the Home Office.
Section 3.2 of Annex B to Chapter 18 wrote:The start of the qualifying period of 5(3) years is the day after the
corresponding application date.

Does it mean we never know the application will be received by HomeOffice?

Can someone suggest me, usually how many days will it take for the Home office to receive the application once it is taken by NCS.

I think they use next day delivery options, if I am correct.

The NCS should normally send your application special delivery and they should be able to give you the tracking number for the special delivery envelope they will use for your application. Make sure you ask them for that at the appointment.

Today I have checked the status and the post is delivered today

Royal Mail track trace information :

Your item with reference SC123456789GB was delivered from our LIVERPOOL SOUTH Delivery Office on 19/12/13 .

Now I am bit relieved. Thank you everyone.

But I made a mistake in my application. Instead of filling departure and arrival dates on page 8, I have filled acutal absent days ( absent-from & absent-to) although number of days absent are correct for each trip.

My total absences are about 190 days. Does it make any difference ?
