Is Separate Visitor Visa Required If I hold Tier 2 ICT

Hi,

I am an Indian and have Tier2 ICT which is valid till March 2015.
I was in UK for 1 and half month this year and am currently working in Germany.

Do I need to have a separate visitor visa if I want to enter UK on a personal trip?

Please keep in mind that i wont have any Deputation Letter from my employer nor salary certificate.

are you continuing to work for your T2 ICT sponsor albeit in Germany?

Yes you will if your visit to the UK has nothing to do with your employer. Also bearing in mind that you have only been in the UK for this employer for less than two months out of twelve, so it isn't as if the UK is your main home.

Hi manci,

Yes, I do continue to work for the same employer who had sponsored my CoS.

This visit however will be a personal trip and I won't have any
Papers from my employer.

If the OP is on an assignment in Germany and this has been properly documented by the sponsor in the migrant's records, I think he could travel to the UK on his T2 ICT visa to spend, say, part of his annual leave here.

Don't you think this would be the case?

I would not risk it. You don't work in the UK, you aren't seeking entry to work in the UK. You cannot lie about why you are coming to the UK and the Immigration Officer can refuse you entry.

Grounds on which entry clearance or leave to enter the United Kingdom is to be refused.......

(5) failure, in the case of a visa national, to produce to the Immigration Officer a passport or other identity document endorsed with a valid and current United Kingdom entry clearance issued for the purpose for which entry is sought;
It isn't clear from your post if you even still work for the employer named on the ICT visa.

I do work for the same employer.
Just that i am on an assignment in Germany now.

you have provided insufficient information

Suggest you contact the ECO at the British Embassy visa section in Berlin, Munich or Düssseldorf and disclose all relevant information such as:

* will you be on paid or unpaid leave

* how long is your leave from work and how long do you want to come to the UK for

* why can't you produce a letter from your employer confirming your leave

Don't forget to tell them that you no longer work in the UK too.

I am sure you will be told to get a visitor's visa!

If you are entering UK under a Tier 2 ICT visa you will be expected to be employed in the UK and pay tax....

In your case you are being a tourist so you will need a tourist visa.
Better to get this sorted than being investigated by HRMC.
