Making new Tier2 application with same employer

Post by AustinCann » Sun Dec 22, 2013 8:29 pm

Dear all, wonder if someone can help with my queries here

What are the consequences of receiving a higher salary than the one
used in the COS certificate without making a new application when the salary increase is 10% higher than the one advertised in COS?

If a new Tier 2 application is made after two years of the grant of first Tier 2 general visa, is the new Tier 2 general visa given for another three years?

Many thanks

if you remain with the same employer you only need to make a change of employment application if the SOC code for the job changes.

Note that the sponsor may have to report the pay increase to the HO, ref para
592(d) of the T2 sponsor guidance:

if there are any significant changes in the sponsored migrant’s circumstances, for example:
. a promotion or change in job title/core duties, other than those which require a change of employment application.
. a change of salary from the level stated on the migrant’s CoS, other than changes due to annual increments or bonuses;

If you make a new T2G application with a new CoS, and provided your initial leave was under the rules after 5 April 2011, the grant will be 3 years or the period of engagement whichever the shorter but your total leave cannot exceed 6 years
